DEVELOPMENT SERVICES MEMORANDUM <br /> No. 11-47 <br /> September 14, 2011 <br /> TO: Honorable Mayor Michael T. McElroy and City Council <br /> FROM: Ryan P. McCrady, City Manager <br /> Billy Tyus, Assistant City Manager <br /> Suzan M. Stickle, Senior Planner <br /> SUBJECT: Rezone from M-1 Intense Commercial/Light Industrial District to R-1 Single <br /> Family Residence District in the 2300 Block West Mound Road <br /> SUMMARY RECOMMENDATION: Staff recommends approval of the rezoning. <br /> The City Plan Commission voted 6-0 to recommend approval of this petition at the September 1, <br /> 2011 meeting; the minutes of the meeting are attached. <br /> BACKGROUND: The 36,244 square foot subject site is located in the 2300 Block of West <br /> Mound Road and is currently undeveloped. <br /> The petitioner proposes to rezone from M-1 Intense Commercial-Light Industrial District to R-1 <br /> Single Family Residence District in order to construct a Single Family Residence and with the <br /> intent to create a sustainable energy home by using wind energy. A petition will have to be filed <br /> and heard by the Plan Commission and approved by the City Council before a wind generator <br /> could be utilized on the property. <br /> The surrounding zoning includes R-1 Single Family Residence District to the north and east and <br /> M-1 Intense Commercial-Light Industrial District to the north, south and west. The Decatur <br /> Urban Area Land Use Plan shows this area as Light Industrial. The existing use is compatible <br /> with adjacent uses to the north and east. The uses to the west and south are also compatible uses <br /> with a single family residence. The rezoning of this property to R-1 Single Family Residence <br /> District should not have an adverse effect of the surrounding area. Nor should the surrounding <br /> uses have an adverse effect on the proposed use as a single family residence. <br /> POTENTIAL OBJECTION: There were no known objectors at the Plan Commission <br /> Meeting. <br /> INPUT FROM OTHER SOURCES: The rezoning has been reviewed by the City's Technical <br /> Review Committee; Planning, Engineering and Fire have approved the rezoning. <br /> STAFF REFERENCE: Any additional questions may be forwarded to Suzan M.
