DEVELOPMENT SERVICES MEMORANDUM
No. 11-47
September 14, 2011
TO: Honorable Mayor Michael T. McElroy and City Council
FROM: Ryan P. McCrady, City Manager
Billy Tyus, Assistant City Manager
Suzan M. Stickle, Senior Planner
SUBJECT: Rezone from M-1 Intense Commercial/Light Industrial District to R-1 Single
Family Residence District in the 2300 Block West Mound Road
SUMMARY RECOMMENDATION: Staff recommends approval of the rezoning.
The City Plan Commission voted 6-0 to recommend approval of this petition at the September 1,
2011 meeting; the minutes of the meeting are attached.
BACKGROUND: The 36,244 square foot subject site is located in the 2300 Block of West
Mound Road and is currently undeveloped.
The petitioner proposes to rezone from M-1 Intense Commercial-Light Industrial District to R-1
Single Family Residence District in order to construct a Single Family Residence and with the
intent to create a sustainable energy home by using wind energy. A petition will have to be filed
and heard by the Plan Commission and approved by the City Council before a wind generator
could be utilized on the property.
The surrounding zoning includes R-1 Single Family Residence District to the north and east and
M-1 Intense Commercial-Light Industrial District to the north, south and west. The Decatur
Urban Area Land Use Plan shows this area as Light Industrial. The existing use is compatible
with adjacent uses to the north and east. The uses to the west and south are also compatible uses
with a single family residence. The rezoning of this property to R-1 Single Family Residence
District should not have an adverse effect of the surrounding area. Nor should the surrounding
uses have an adverse effect on the proposed use as a single family residence.
POTENTIAL OBJECTION: There were no known objectors at the Plan Commission
Meeting.
INPUT FROM OTHER SOURCES: The rezoning has been reviewed by the City's Technical
Review Committee; Planning, Engineering and Fire have approved the rezoning.
STAFF REFERENCE: Any additional questions may be forwarded to Suzan M. Stickle at 424-
2786 or at smstickle@decaturil.gov.
BUDGET/TIME IMPLICATIONS: None.
