4 <br /> a.The tower should not be accessible for unassisted climbing. This can be <br /> prevented by not providing rungs for the first twelve (12) feet, covering <br /> the climbing apparatus, enclosing the base of the structure with a six (6) <br /> foot fence, or by any other approved preventative measures. It shall be a <br /> violation of this Section for any unattended Wind Energy System to be <br /> accessible for unassisted climbing. <br /> 13. Color. <br /> a.The Wind Energy Systems shall be of a neutral color, such as white or light <br /> grey, and the surface shall be non-reflective. <br /> 14. Lighting. <br /> a.No lights shall be installed on any part of the Wind Energy System, unless <br /> required to meet FAA regulations. <br /> 15. Soil Studies. <br /> a.Provide proof that the site's soil conditions meet the minimum standards as <br /> specified by the tower turbine manufacturer. <br /> b. Formal site soil analyses are not necessary or required for residential <br /> scale turbines if they are designed to withstand worst case scenario soil <br /> conditions. <br /> c.For turbines greater than twenty (20kW) kilowatts, a Structural Engineer's <br /> seal will be required as well as a full soil analysis of the site. <br /> 16. Liability Insurance. <br /> a.Proof of liability insurance for a duration of not less than 24 months from <br /> the estimated completion date of construction of the Wind Energy <br /> System, covering loss or damage to persons or property occasioned by <br /> failure of the facility, shall be provided, and updated proof shall be <br /> provided annually thereafter. <br /> 17. Local Historic Districts, Local Landmarks, and National Historic Districts. <br /> a.Wind Energy Systems located within the Local Historic Districts or on the <br /> site of a Local Landmark may be installed as long as the applicant <br /> receives a Certificate of Appropriateness from the Historical and <br /> Architectural Sites Commission prior to submitting an application to the <br /> Plan Commission and City Council. <br /> b. Wind Energy Systems located within a National Historic District or on <br /> the site of a National Landmark must receive a recommendation from the <br /> Historical and Architectural Sites Commission prior to submitting an <br /> application to the Plan Commission and City Council. <br /> c.Wind Energy Systems within five-hundred (500) feet of a Local Historic <br /> District or Landmark or a National Historic District or Landmark must <br /> receive a recommendation from the Historical and Architectural Sites <br /> Commission prior to submitting an application to the Plan Commission <br /> and City Council. <br /> C. APPLICATION <br /> The owner or owners of the Wind Energy System and/or tract of land must submit to <br /> the Plan Commission a plan for the use of a wind energy system for the purpose of <br /> meeting the requirements set forth in this Section.
