Marley, P.E., Director of Public Works <br /> SUBJECT: Agreement with Norfolk Southern Railway Company for Brush College Road <br /> Project, City Project 2009-33 <br /> SUMMARY RECOMMENDATION: <br /> It is recommended that the City Council approve the attached resolution authorizing the Mayor to <br /> sign and the City Clerk to attest the Preliminary Engineering Agreement between the City of <br /> Decatur and the Norfolk Southern Railway Company. <br /> PRIOR COUNCIL ACTION <br /> • July 6, 2010—The City Council approved resolution R2010-140, authorizing Agreement <br /> with URS Corporation for Engineering Design Services for the Brush College Road <br /> Underpass (Subway) Study(CP 09-33). <br /> • May 16, 2011 —The City Council met in Study Session to hear a report of the progress of <br /> the Brush College Road Study. <br /> • November 7, 2011 —The City Council approved resolution R2011-175, authorizing <br /> Change Order#1 which added the intersection of Faries Parkway with Brush College Road <br /> to the study area. <br /> NEED FOR AGREEMENT: <br /> One of the biggest stakeholders for the Brush College Road project is the Norfolk Southern <br /> Railroad (NS). Safety and traffic concerns at the underpass of Brush College at the NS railyard <br /> were the impetus for this project. In addition, the Faries Parkway intersection was added to the <br /> project out of traffic concerns when trains cross Brush College Road at the intersection. <br /> URS, the City's Consultant for the Brush College Road Project, has advanced the project to a <br /> point where review and acceptance of the proposed improvements from NS is required. In order <br /> for the railroad to officially review any plans and reports that URS produces, the City must enter <br /> into a Preliminary Engineering Agreement with NS. The agreement is attached. <br /> Norfolk Southern must use in-house and consultant services for the preliminary engineering <br /> review; therefore, the agreement includes provisions that the City will pay$26,845 for the work. <br /> POTENTIAL OBJECTION: There are no known objections to this resolution. <br /> Page I 1 <br />
