LEASE THIS LEASE, made and entered into by and between the CITY OF DECATUR, ILLINOIS, a municipal corporation (hereinafter referred to as "CITY"), and 101 MAIN PLACE, LLC, (hereinafter referred to as "ONE MAIN"). WITNESSETH: 1. Premises. The CITY does hereby demise and lease to ONE MAIN the following described premises: a. Up to ten (10) parking spaces and one (1) ADA parking space (for weekdays between the hours of 9:00 a.m. and 4:30 p.m.) in the City's parking area of the parking lot as shown on EXHIBIT A. 2. Exclusive Use. During the term of this Lease, ONE MAIN shall enjoy exclusive use and possession of all said parking spots from 9:00 a.m. to 4:30 p.m. Monday through Friday. 3. Term. The term of this Lease shall commence on and shall terminate one (1) year from the date of commencement with mutual renewal options of another one (1) year not to exceed four (4) renewals, except as may be earlier terminated by the provisions of this Lease. 4. Rent. ONE MAIN shall not be required to pay to the CITY, any rent for the above- described premises. 5. Taxes. ONE MAIN shall pay their pro rata share of taxes, if any, due on the above- described premises which are attributable to ONE MAIN's Lease or use of the premises. 6. Compliance with Laws. ONE MAIN agrees to observe and comply with all rules, regulations, ordinances, statutes and zoning laws now in force or which may be ' enacted during the continuation of this Lease by the CITY or any other Municipal, County, State or Federai authority and to indemnify the CITY for any damage caused by violation thereof. 7. Release. ONE MAIN, in using the premises, does so at its own risk. The CITY shall not be liable for any damages to property sustained by ONE MAIN on the premises, or any portion thereof, except as resulting from the CITY's violation of any term of this Lease. Except as resulting from the CITY's violation of any term of this Lease, ONE MAIN assumes full responsibility for property damages or injuries which may occur to ONE MAIN or its officers, employees, directors, agents or contractors, resulting from or arising out of ONE MAIN's use of the premises. ONE MAIN does hereby fully and forever on its own behalf release and discharge the CITY and the CITY Council members, CITY employees, officers, invitees and agents, in both individual and official capacities, from any and all claims, demands, damages, rights of action, present or future, whether the same be known, anticipated or unanticipated, whether due to negligence or otherwise, resulting from or arising out of ONE MAIN's use of the premises, except as resulting from the CITY's violation of any term of this Lease.
