14.3 Non-Conflict or Breach. Neither the execution and deliveiy of this A��•eement, nor the consummation of the transactions contemplated hereby, nor tlie fulfillment of or com�liance with tl�e terms and conditions of this Agree�nent, conflicts with or results in a breach of any of tha tecros, conditions or provisions of any restriction, a�•eemecit or instrument to which t[ie RedeveIoper is now a party or by which the Redeveloper is bound. 14.4 Pending Lawstiits. There are no lawsuits either pending or threatened tl�at would materially, adversely affect the ability of the Redeveloper to proceed with the construction and development of the Project on the Project Site. 14.5 Location of Project. The Project will be located within the Project Site. 14.G Co�Rformance with Requirements. The Redevelopec i•ept�esents and warrants that the Construetion Plans and construction of tlie Project in accordance with the Constivction Plans will in all respects conform to and comply with all covenants, conditions, restrictions, zoning ordinances, environmental regulations and land use regulations affec#ing the Project Site. ARTICLE XV:REPRES�NTATIONS OF THE CITY TI�e City represents, warrants and agrees as a basis for the undertakings on its part contained herein that: 15.1 Organization and Autlwcization. The City is a municipal coiporation ocganized and existing undcr the iaws of ttie state of Iilinois, and lias the power to enter into and by proper action has been duly authorized to execute,deliver and perfottin tl�is Agreement. 15.2 Non-Conflict or Bi•eacl�. Neither the execution and delivery of this Agreement, nor tl�e consummation of tl�e tcansactions contemplated here6y, nor the fi�lfillment of or compliance with the tet•ms and conditions of this Agreement,conflicts with or results in a breach of any of tlie tecros, conditions or provisions of any restriction, agreement or inst�ument to which the City is now a party or by which the City is bound. 15.3 Peuding Lawsuits. There are no lawsuits eitlier pending or threatened thaY would affect the ability of the City to perfor�n this Agreement. ARTICL�XVI: MISCELLAN�OUS 16.1 Prevailing Wages. Ff the Redeveloper receives Public Investinents as set foi�th in Article IV above in the construction of the Project, the Redeveloper shall pay prevailing wages as determined pursuant to tlze Prevailing Wage Act of the State of Illinois, 820 ILCS 130 et seq at�d the Prevailing Wage Ordinance of the City subject to the following: (a) A listing of the curcent prevailing wage rates is available through the City. (b) Contracto�•s must comply with provisions of Public Act 93-38 which requices eertain]anguage pertaining to�revailing wage be inserted into subcontracts.
