� I1. PUBLIC OFFICIAL LIABILITY INSURANCE AND PRESENTATION BY <br /> LEGAL COtJNSEL. The City may provide Employee with public o icial liability insurance in <br /> accordance with such provided for other officers of the City. In a dition, if the Employee is <br /> named or made a party to any action, claim, or demand in any court or administrative tribunal for <br /> any claim, cause of action, suit, or demand, except for criminal, traf ic, misdemeanor, or petty <br /> offenses, which arise from his actions or conduct as an employee of th City, the City shall select <br /> and compensate an attorney who shall provide a defense for Employ e, unless the City Council <br /> determines that said Employee was acting outside of the scope of his uties when engaged in the <br /> actual conduct which forms the basis of the suit. <br /> 12. HOLIDAYS. Employee shall receive the same paid holi ays which are afforded to <br /> other officials of the City. <br /> 13. DISABILITY. If Employee is totally disabled or othe ise unable to perform all <br /> of his duties because of sickness, accident, injury, mental incapacit or ill health, he shall be <br /> eligible for disability leave upon exhausting all accrued sick leave and vacation leave. Disability <br /> leave shall be unpaid and shall be approved by the City for a period of up to six months. The <br /> length of such time period of disability leave shall be dependent upo the length of disability as <br /> demonstrated by Employee. If Employee is unable to return to wo k at the end of disability <br /> leave, the City shall have the option to terminate the employment o Employee, subject to the <br /> requirements imposed elsewhere herein on the parties relating to termi ation. <br /> 14. TERMINATION. (a) The City may terminate this greement at any time, for <br /> any cause or no cause, by appropriate action of the City Council, w ich action shall include a <br /> majority vote of the members of said Council. (b) Employee may terminate this <br /> Agreement at any time, for any cause or no cause, by providing to the City thirty (30) days prior <br /> 5 <br />
