, � . � 13. Commercial General Liabilitv: General Aggregate Limit $10,000,000 Products-Completed Operations Aggregate Limit $10,000,000 Each Occurrence Limit $10,000,000 14. Insurance shall be written in the occurrence form and shall provide coverage for operations of the LICENSEE; operations of subcontractors (contingent or protective liability); and completed operations; [broad form property damage and hazards of explosion, collapse and underground; and contractual liability.] The coverage shall provide by endorsement that the City of Decatur, its officers and employees shall be named as additional insureds with respect to the policies and any excess liability coverage for occurrences arising in whole or in part out of the work and operations performed. There shall not be any exclusions limiting property damage or barring explosion, collapse or underground operations, and LICENSEE'S insurance must be primary. CITY may accept a separate owner's protective liability policy in lieu of additional insured status on LICENSEE'S liability policies. 15. Commercial Automobile LiabilitY: Bodily Injury 8� Property Damage Limit Each Occurrence $5,000,000 The policy shall cover owned, non owned and hired vehicles. The coverage shall provide by endorsement that the City of Decatur, its officers, and employees shall be named as additional insureds with respect to the policies and any excess liability coverage for occurrences arising in whole or in part out of the work and operations performed, and the contractor's insurance must be primary. 16. Umbrella (Excess) LiabilitY: Any policy shall provide excess limits over and above the other insurance limits stated herein. LICENSEE may purchase insurance for the full limits required, or a combination of primary policies for lesser limits and remaining limits provided by the umbrella policy. LICENSEE shall file with CITY, certified copies of the original policies or certificates of insurance setting forth the coverage, limits, and endorsements. A certificate of insurance shall include the statement: "the coverage and limits conform to the minimums required by the City of Decatur for Secure Energy Decatur, LLC, Hubbard Avenue Sewage Force Main" Indicating the City's additional insured status. In no event shall any failure of CITY to receive certificates or to demand receipt be construed as a waiver of the LICENSEE'S obligation to obtain and keep in force the required insurance. All costs for said insurance shall be considered incidental to the LICENSE AGREEMENT. Coverage in the minimum amounts set forth herein shall not be construed to relieve the LICENSEE from its obligation to indemnify the CITY in excess of the coverage according to the LICENSE AGREEMENT. 17. LICENSEE, as further consideration and as a condition without which this license would not have been granted, agrees to indemnify and save harmless CITY, its officers, employees, and agents, and to assume afl risk, responsibility and liability for death of or injury to any persons, including but not limited to officers, employees, agents, other
