Excerpts of Decatur City Plan Commission Meeting August 4, 2005
Cal.No. OS-38 Petition of MATTHEW E. JACKSON, for a Conditional
Use Permit for the premises located at 308 West Main
Street(aka 300 West Main Street)to allow for a mixed use
(residential use and office use) in the historic structure.
Ms. Miller gave the recommendation of staff: '
The Linn House (approximately 5500 square feet) occupies the 18,544 square foot
property located at 308 West Main Street. The building has recently been used as an
office for the Democratic Party and for the Jones and Thomas Advertising firm.
Currently there is parking on the west and north sides of the building.
The petitioner is requesting a conditional use permit to use the structure as a residence
and as a family practice physician's office.
The petitioner plans to add porches and a lift to the structure to accommodate both uses.
The reaz portion of the first floor will be used as the doctor's office. The remainder of
the first floor and the second floor will be living space. The office will be handicapped
accessible. The petitioner plans to remove the parking at the reaz of the structure and
construct a new three-car garage.
The subject property is located between the Downtown Business District and the locally
designated West End Historic District, within the boundaries of the Decatur National
Register Historic District. Most of the properties in this area are zoned 41 Office
District; the area serves as a buffer between the Downtown Business District and the
Residential District to the west. Most properties located within the block are office uses;
St. Paul's Lutheran Church is located across the street.
A Conditional Use permit will allow a mixed us-residential and any combination of
office and/or commercial in the same building in an al Office District. The public
health, safety and welfaze will be protected and the use will not be detrimental to property
values in the neighborhood.
The historical.and architectural character of the building will be preserved. The only
changes proposed to the exterior is the addition of porches that match the style of
previous porches located on the structure. A three car garage will be located at the reaz of
the structure eight feet from the existing building and three feet from the property line as
required by the Zoning Ordinance.
Adequate parking for the physician's office as well as the residence will be provided on
the site. The side yard parking lot setback of five (5) feet will not be required as the
parking lot is existing and there are no parking lot changes proposed in this portion of the
parking lot. The proposed landscaping meets the requirements of the Zoning Ordinance.
