. � . <br /> STAFF REPORT <br /> Decatur City Plan Commission <br /> COMMON NAME: City of Decatur Zoning Ordinance <br /> GENERAL INFORMATION <br /> Hearing Date November 4, 2004 <br /> Calendar No. 04-51 <br /> Requested Action Amendments to Zoning Ordinance (Ordinance#3512) <br /> Petitioner Dane C. Bragg, Assistant City Manager <br /> BACKGROUND <br /> 1. The cunent City of Decatur Zoning Ordinance was adopted in May of 2002. Since the time <br /> of adoption, staff has discovered certain necessary changes, discrepancies and omissions as <br /> the new ordinance has been implemented. <br /> DESCRIPTIUN <br /> 1. Section XXVIII.J.16 (Off-Premise Sign Lighting). The lighting used for off-premise signs <br /> shall not exceed "30" footcandles instead of ??. This was inadvertently left unchanged when <br /> the Ordinance was written. <br /> 2. Section XXI.D.3 (Exceptions to Front Yard Setback Requirements-Porches and Terraces). <br /> Proposed addition to the exceptions "An existing non-conforming porch or terrace may be <br /> replaced or rebuilt to its cunent dimensions, provided that the replacement structure does not <br /> project into the required front yard more than eight (8) feet;" and numbering the paragraphs <br /> accordingly. <br /> STAFF RECOMNIENDATION <br /> 3. Staff recommends approval of the amendments as proposed. <br /> PLAN COMIVIISSION ACTION <br /> 4. Section XXIX.G. of the Zoning Ordinance requires Plan Commission to hold a public hearing <br /> and make recommendations to the City Council on amendments to the Zoning Ordinance.
