No. 04-56 Petition of ARCHITECTURAL RESTORATIONS, INC., <br /> for a Conditional Use Permit—Historic Neighborhood Use <br /> for the premises at 411 West Main Street to operate a tea <br /> room and antique shop (Section IX.B.S.) in an R-6 Multiple <br /> Dwelling District. <br /> Ms. Suzan Stickle gave the following recommendation of staff: ' <br /> The petitioner owns and has restored the single family structure on the property located at I'� <br /> 411 West Main Street. The petitioner proposes to utilize the single family structure as a <br /> tearoom. <br /> The Historical and Architectural Sites Commission found that the proposed use will <br /> preserve the historical character of the building and voted unanimously to recommend <br /> approval of the conditional use permit-historic neighborhood use at the Wednesday, <br /> October 20, 2004 meeting. <br /> The Traffic and Parking Commission granted a request for an on street handicapped <br /> parking stall in the 100 Block of South Edward Street on Tuesday, October 13, 2004. <br /> The parking in the rear of the structure did not provide adequate access for handicap <br /> accessibility. A lift will be installed on the front porch to allow for accessibility to the <br /> building. <br /> The petitioner is requesting a conditional use permit to operate a tearoom as a historic <br /> neighborhood use at 411 West Main Street; the premises is currently zoned R 6 Multiple <br /> Dwelling District. The proposed tearoom will operate for lunch from 10:00 A.M. to 2:00 <br /> P.M. Tuesday through Saturday and will be open for formal teas as well. There will be <br /> dining areas on both the first and second floors. <br /> The required number of parking spaces for the proposed use is 33 spaces. There will be <br /> two (2)parking spaces provided in the rear of the structure. The petitioner has secured an <br /> agreement with St. Paul's Lutheran Church for the use of their parking lots; 27 spaces on <br /> the Wood Street lot, 39 spaces on the Main Street lot and 72 spaces on their east lot. The <br /> Wood Street lot and the Main Street lot are both within 300 feet of the subject property <br /> which is required by the Zoning Ordinance. With two (2) of the three (3) parking lots <br /> under agreement with St. Paul's being within 300 feet, the tearoom meets the required <br /> number of parking spaces. <br /> The subject property is surrounded by R-6 Multiple Dwelling District to the north, west <br /> and east. There is also O-1 Office District abutting the southeast portion of the property. <br /> The abutting property to the south is zoned B-2 Commercial District. The subject <br /> property is located in an area consisting of parking lots, churches, offices as well as <br /> single and multi-family residences. All of these land uses are compatible uses with that <br /> of a tearoom. <br /> Section XXII. (Conditional Use Regulations) of the Zoning Ordinance (Ord. #3512, as <br /> amended) provides for a historic neighborhood use in any zone located within the <br /> boundaries of the Decatur Historic District providing such use preserves the historic <br />
