towing and storage records of Prairieland relating to services provided hereunder shall be made <br /> available for inspection by the City at the premises of Prairieland. The equipment, evidence <br /> bay, storage yard, and dispatcher's area of Prairieland shall be subject to inspection by the City <br /> at any time. The City shall take such reasonable measures so as not to interfere with the business <br /> of Prairieland in performing such inspection(s). Nothing contained herein shall affect or impair <br /> any rights or obligations of either party hereto in relation to the service of any warrant or <br /> command of any court or agency of competent jurisdiction. <br /> 11. Citv Duties. Although the City neither warrants nor represents a minimum <br /> number of vehicles requested to be towed and/or stored under the terms hereof, in any situation <br /> where a vehicle is found by the City or the Decatur Police Department to require towing as a <br /> result of being: (i) abandoned, (ii) parked illegally or unlawfully, (iii) a traffic hazard, (iv) <br /> required to be impounded by the Decatur Police Department, (v) evidence in a matter under <br /> investigation by the Decatur Police Department, or(vi) formerly operated by an individual being <br /> taken into custody by the Decatur Police Department, Prairieland will be contacted by the City or <br /> the Decatur Police Department to provide towing and/or storage services. In addition, in the case <br /> of a vehicular collision or automobile accident, where the owner or operator, for whatever reason <br /> is incapacitated or otherwise incapable of approving a towing service or the owner or operator <br /> does not request the services of a specific towing services company, and the Decatur Police <br /> Department is authorizing the provision of towing and/or storage services, the Decatur Police <br /> Department will contact Prairieland to perform the towing and/or storage services. <br /> When the Decatur Police Department contacts Prairieland for the provision of services <br /> hereunder, the Decatur Police Department shall identify, in writing, whether the vehicle <br /> registration is present in the vehicle and provide to Prairieland a reasonably complete inventory <br /> of personal property with an estimated fair market value in excess of$300.00 located within the <br /> subject vehicle. In providing the inventory described herein, the City may describe items <br /> generally. <br /> 12. Pavment Duties of the Citv. With respect to any vehicle towed and/or stored <br /> pursuant to the terms hereof, the City shall have no liability or obligation to Prairieland for any <br /> fee, cost, charge or expense unless such towing or storage was the result of an enor by the City <br /> of an officer of the Decatur Police Department. Should Prairieland provide towing and/or <br /> storage services as the result of an error by the City or an officer �bf the Decatur Police <br /> Department, Prairieland shall provide to the City an invoice(in duplicate) to the City of Decatur, <br /> Accounts Payable, #1 Gary Anderson Plaza, Decatur, Illinois 62523, or such location as the City <br /> may direct hereafter. All invoices must be for an exact amount with reasonable description of <br /> the services provided. The City will remit payment thereon in due course, not to exceed thirty <br /> (30) days after receipt of the invoice in accordance herewith. <br /> 13. Collection of Fees and Char�es. The City is not responsible to Prairieland for <br /> the collection of fees and charges incurred in the towing and/or storage of vehicles subject to the <br /> terms of this Agreement. However, the City recognizes that Prairieland is entitled to <br /> compensation for the services rendered hereunder, and subject to the provisions hereof the City <br /> shall not act in any manner or fashion to impair, hann, lessen or compromise any lien or claim <br /> —5— <br />
