Prairieland may possess by law or agreement or the right of Prairieland to receive payment for
the services described herein so long as such fees and charges are set forth in Schedule A
attached hereto. Notwithstanding anything to the contrary herein, the City may act to protect the
integrity of evidence necessary for actions by the Decatur Police Department.
14. Complaints. Prairieland shall provide a consumer complaint procedure
available to individuals or entities dealing with Prairieland in relation to the subject matter
hereof, which procedure shall include a written document to be completed by the individual or
entity dealing with Prairieland in a form substantially similar to that exemplar attached hereto
and made a part hereof as Exhibit B. Prairieland will provide to the Decatur Police Department a
copy of any written consumer complaint received by Prairieland in relation to Prairieland
services provided hereunder. Should any individual or entity complain in writing to the City or
the Decatur Police Department about Prairieland in the performance of duties set forth herein,
the City (or the Decatur Police Department, as the case may be) shall deliver to Prairieland,
within fourteen(14) days after receipt thereof, a copy of said complaint.
15. Personal Property Contained Within Vehicle. Prairieland shall provide a
reasonable means for individuals having the lawful right of immediate possession of personal
property, excluding accessions to said vehicles, contained within vehicles towed and/or stored
pursuant to the terms of this Agreement to obtain possession thereof. If an item of personal
property is identified to Prairieland for release, and such item is of a nature as to be, or
transportation thereof may be, suspicious, dangerous, unlawful or illegal, Prairieland may contact
the Decatur Police Department rather than release the item immediately to the person requesting
release thereof. In the case of contraband, Prairieland is likewise permitted to deliver the same to
the possession of the Decatur Police Department rather than releasing the same to the person
requesting its release.
Prairieland may demand reasonable identification from such individual claimants (by
way of eYample and not excluding other means, photographic identification such as a valid
driver's license) and demand further that said claimants reasonably identify the personal property
for which release is sought or requested and that said claimants indemnify and hold hannless
Prairieland for the release of such personal property. Without limiting other similar types of
requests for release of such personal property, the accurate and truthful completion of the
exemplar, attached hereto and made a part hereof as Exhibit C, shall be deemed appropriate for
an authorization for release of such personal property.
Prior to execution hereof, Prairieland has instituted a Policy, a true and accurate copy of
which is attached hereto and made a part hereof as Exhibit D, which the City agrees is sufficient
in order to comply with the terms hereof relating to the release of personal property located •
within vehicles towed and/or stored pursuant to the terms hereof.
In addition to the Fee Schedule provided as set forth in § 6 hereof, Prairieland will, to the
extent reasonably possible, provide to the owner or operator of the automobile towed or stored
pursuant to the terms of this Agreement, a copy of the procedure for retrieving personal property
—6—
