that might be contained within the vehicle from Prairieland, which written procedure will be <br /> substantially similar to the exemplar attached hereto and made a part hereof as Exhibit E. <br /> Notwithstanding anything to the contrary herein, should the State of Illinois enact �, <br /> legislation expressly authorizing entities such as Prairieland to collect a deposit and/or payment <br /> of all fees and charges, Prairieland will be permitted hereunder to act in accordance with the <br /> provisions of such legislation. <br /> 16. Release of Vehicle. Absent authorization from the City or the Decatur Police <br /> Department, Prairieland shall not release any vehicle, towed and/or stored pursuant to the terms <br /> hereof, which vehicle was involved in a traffic violation or matter under investigation by the <br /> Decatur Police Department and which has been identified by the Decatur Police Department as <br /> being the subject of a hold placed thereon by the Decatur Police Department. Such vehicles shall <br /> be released as directed by the Decatur Police Department after all towing and storage fees and <br /> charges have been satisfied. <br /> Other vehicles towed and/or stored pursuant to the terms hereof shall be released to the <br /> registered owner of the vehicle after satisfaction, in full, of all towing and storage fees and <br /> charges incurred in relation to said vehicle. If the vehicle is to be released to any individual or <br /> entity other than the registered owner thereof, Prairieland may demand that the registered owner <br /> provide written authorization for said release and that the person receiving possession of the <br /> vehicle provide appropriate identification. Without limiting other similar types of authorizations, <br /> accurate and truthful completion of the exemplar, attached hereto and made a part hereof as <br /> Exhibit F, shall be deemed appropriate for an authorization for release of a vehicle to an <br /> individual who is not the registered owner of the vehicle. <br /> Without limiting other reasonable requirements for release of vehicles to appropriate <br /> individuals, Prairieland may also require that the individual to whom the vehicle is released <br /> provide indemnification to Prairieland should a later claim be made against Prairieland that the <br /> vehicle was released improperly. <br /> In addition to the Fee Schedule provided as set forth in § 6 hereof, Prairieland will, to the <br /> extent reasonably possible, provide to the owner or operator of the automobile towed or stored <br /> pursuant to the terms of this Agreement, a copy of the procedure for retri�eving the vehicle from <br /> Prairieland, which written procedure will be substantially similar to the exemplar attached hereto <br /> and made a part hereof as Exhibit E. - <br /> Notwithstanding anything to the contrary within this Section, the City may direct, in <br /> writing, Prairieland to release a vehicle, towed and/or stored pursuant to the terms hereof, to an <br /> individual designated by the City. In such circumstances, Prairieland may demand the individual <br /> to whom the individual is being released to agree to hold harmless and indemnify Prairieland <br /> from any and all loss or liability associated with the release of said vehicle. Further, the City will <br /> hold hazmless and indemnify Prairieland from any and all loss, liability, cost or expense incurred <br /> or suffered by Prairieland as a result of releasing a vehicle to an individual as directed by the <br /> City, in writing. The City shall provide to Prairieland a written direction and authorization <br /> —7— <br />
