from the City, NS and ICRR shall include the Commission Order Number, the Order <br /> date, the project completion date as noted in the Order, crossing information (Inventory <br /> Numbers and Railroad Mileposts), type of improvement, and project manager <br /> information (name, title, mailing address, phone number and facsimile number of the <br /> employee responsible for management of the project.) The progress reports shall also <br /> include the status of expenditures of the total project and percentage of completion of <br /> the project. If the project is behind schedule, the reports must include a brief <br /> explanation of the reason(s) for the delay. <br /> SPc-ti�n S� The parties hereto agree that an equitable division of cost to perform the <br /> proposed improvements should be: <br /> a. the cost for the City to perForm its work proposed herein as set forth on attached <br /> Exhibit A, estimated to be $230,000, should be allocated 90% of the actual cost, <br /> not to exceed $207,000, to the Grade Crossing Protection Fund (GCPF) of the <br /> Motor Fuel Tax Law, and the remaining cost, and all future cost of operation and <br /> maintenance, to the City. <br /> b. the cost for NS to perform its work proposed herein as set forth on attached Exhibit <br /> B, estimated to be $15,000, should be allocated 100% of the actual cost, not to <br /> exceed $15,000, to the GCPF, and any remaining cost, and all future cost of <br /> operation and maintenance, to NS. <br /> c. the cost for ICRR to perform its work proposed herein as set forth on attached <br /> Exhibit C, estimated to be $2,080, should be allocated 100% of the actual cost, not <br /> to exceed $2,080, to the GCPF, and any remaining cost, and all future cost of <br /> operation and maintenance to ICRR. <br /> S�ction 6� The City is financially able and willing to bear an equitable portion of the <br /> cost for the proposed improvements as may be assigned by the Order and indicates <br /> this intent by Resolution attached as Exhibit D. <br /> Section 7� The City agrees to post a readily visible notice inside its traffic signal <br /> cabinets at Brush College Road/Faries Parkway, Martin Luther King Jr. Drive/Wood <br /> Street and 27th StreeUFaries Parkwa notif in its erso <br /> , nnel not to alter the railroad <br /> Y Y 9 P <br /> preemption sequence for its traffic si nals in a manner which would reduce the amount <br /> 9 <br /> of time vehicles encroaching the track zone would have to clear the track without <br /> Commission approval. An actual size copy of such notice shall be submitted to the <br /> Commission's Rail Safety Program Administrator for approval before being installed. <br /> Section 8� This a reement shall be bindin u on the arties here <br /> 9 g p p to, their successors or <br />' assigns.
