' r • �« <br /> Page 2 <br /> BACKGROUND: <br /> In 1990, the United States Environmental Protection Agency(USEPA) established Phase I of the <br /> National Pollutant Discharge Elimination System (NPDES) storm water program. NPDES Phase <br /> I required the operators of inedium and large MS4s (generally with populations over 100,000) to <br /> implement a storm water management program to control pollutant discharges from their <br /> separate storm sewer systems. Phase II of the NPDES program extends the requirements for <br /> storm water control to communities or entities referred to as small MS4s. Small MS4s include <br /> cities, universities, hospitals, military bases, departments of transportation, etc. In all, over 5,000 <br /> communities nationwide are required to meet the new storm water regulations and must be <br /> covered under a storm water permit as of March 10, 2003. <br /> Local entities that have been notified of needing to meet NPDES Phase II storm water <br /> requirements include: the City of Decatur, Macon County, the Village of Farsyth, the Village of <br /> Mt. Zion and the Village of Harristown. The Illinois Department of Transportation is also <br /> covered under the Phase II requirements. Over the past five months, City staff has worked with <br /> representatives from Macon County, Forsyth, Mt. Zion and Harristown in preparing the attached <br /> NOI. <br /> The Illinois Environmental Protection Agency (IEPA) has been designated by the USEPA to <br /> administer the NPDES permit in Illinois. To this end, the IEPA has issued a state wide permit, , <br /> General NPDES Permit No. ILR40 (attached hereto), that regulates discharges from municipal <br /> separate storm sewer systems. By submitting the Notice of Intent, the City is informing the IEPA ' <br /> (1) that it intends to be covered under the state wide permit and; (2) the management programs <br /> that the City intends to put in place over the next five years to meet the permit requirements. <br /> The National Pollutant Discharge Elimination System requires separate storm sewer system <br /> owners / operators to implement storm water management programs (termed "Best Management <br /> Practices (BMPs)" in the permit) that encompass the following minimum control measures: <br /> 1. Public education and outreach on storm water impacts. This control measure requires <br /> the City to inform and educate the public on storm water issues. <br /> 2. Public involvement/ participation. This control measure requires the City to allow for <br /> public participation in storm water issues addressed by the City. <br /> 3. Illicit discharge detection and elimination. This control measure requires the City to <br /> detect and eliminate illicit discharges (non storm water discharges) from the separate <br /> storm sewer system. <br /> 4. Construction site storm water runoff control. This control measure requires the City <br /> to develop, adopt and enforce erosion and sediment control regulations for construction <br /> activities. <br /> 5. Post-construction storm water management in new development and <br /> redevelopment. This control measure requires the City to develop, adopt and enforce <br /> regulations on storm water discharges from new development or redevelopment sites. <br />
