� . - . �5X - .�'��a� <br /> AGREEMENT <br /> for <br /> Local Agency Railway-Highway <br /> Grade Crossing Improvements <br /> THIS AGREEMENT made and entered into this � day of July, 2002, by and between <br /> the CITY of DECATUR, ILLINOIS, hereinafter referred to as the "CITY" and the CSX <br /> TRANSPORTATION, INC., hereinafter referred to as the"RAILROAD". <br /> WITNESSETH: <br /> WHEREAS, RAILROAD has heretofore constructed and maintains automatically operated <br /> flashing light signals, hereinafter referred to as "crossing warning devices" at the crossing, at grade, <br /> of the intersection of 44th Street, DOT Number 154 636L, Railroad Mileposts BD-273.62, with its <br /> tracks in Decatur, Macon County, Illinois, and; <br /> WHEREAS, CITY proposes to erect certain highway traffic signals at the intersection of 44th <br /> Street and U.S. 36 and desires that said signals be interconnected with RAILROAD'S crossing <br /> warning devices (the erection of such highway traffic signals and interconnection with R.AILROAD'S <br /> crossing warning devices, being hereinafter called "Project"), and RAILROAD is willing to permit <br /> the interconnection as aforesaid, subject to the terms and conditions of this Agreement. <br /> NOW, THEREFORE, in consideration of the premises and of the mutual covenants and <br /> r <br /> agreements as hereinafter contained, the parties hereto agree as follows: <br /> RAILROAD shall prepare and submit to the CITY the general interconnection plans. After <br /> both parties have agreed upon such plans and the original preemption arrangement, no changes will <br /> be made within the effective circuits or equipment by either party without the prior written approval <br /> of the other party. <br /> SECTION 2. RAII,ROAD, at sole cost and expense of CTI'Y, will furnish to a common cable <br /> junction box, at its right-of-way line, a preemption circuit of a normally closed contact that will open <br />
