Krieger,Assistant City Manager of Economic and Urban Development , � <br /> Linda Love,Neighborhood Services Director � �� <br /> RE: Public Disclosure for Request of Exception to the Department of Housing <br /> and Urban Development for the Conflict of Interest Regulation <br /> Regulation 24 CFR 570.611,the conflict of interest provision applies to any person who is an <br /> employee, agent, consultant, officer, or elected official or appointed official of the recipient, or of <br /> any designated public agencies, or of subrecipients that are receiving funds. The request to the <br /> Department of Housing and Urban Development covers the following: Decatur Macon County <br /> OpportuniTy Corporation(DMCOC) and Councilman Jim Williams, Decatur Community <br /> Partnership (DCP) and Terry Cunningham, and Decatur Memorial Foundation and Cindy <br /> Laegeler. 'I <br /> Councilman Jim Williams serves on the board of DMCOC. DMCOC is mandated by the "Coats II <br /> Human Services Reauthorization Act of 1988"to assure that 1/3 of the members of the board are ' <br /> elected public officials. Terry Cunningham serves on the board of the Decatur Community <br /> Partnership. Cindy Laegeler,the spouse of Councilman Patrick Laegeler, serves on the board of � <br /> Decatur Memorial Foundation(DMF). <br /> Community Development Block Grant(CDBG) Entitlement Program Regulations 24 CFR <br /> 570.611(a)(2)(d), requires entitlement communities to request an exception to Conflict of � <br /> Interest. This section requires the City of Decatur to prepare a written request to HUD which I <br /> may grant an exception on a case by case basis when the threshold requirements have been ' <br /> satisfied. Regulation 24 CFR 570.611 (a)(2)(d)(1)has the following threshold requirement: (i) <br /> A disclosure of the nature of the conflict, and a description of how the public disclosure was i <br /> made; and (ii) an opinion of the recipient's attorney that the interest for which the exception is <br /> sought would not violate State or local law. <br /> The attached information will be directed to the Department of Housing and Urban Development <br /> with a request for exception to the conflict of interest. <br /> klc <br />
