I <br /> STATE OF ILLINOIS <br /> DEPART'MENT OF TRANSPORTATION <br /> AGREEMENT <br /> for <br /> Loca1 Agency Railway-Highway A 15 6 4 9 <br /> Grade Crossing Improvemerns <br /> THIS AGREEMENT made and entered into by and between the CITY of DECATUR,ILLINOIS, <br /> hereinafter referred to as the"CTI'Y"and the ILLINOIS CENTRAL RAILROAD COMPANY,hereina.fter <br /> referred to as the"COMPANY", <br /> WITNESSETH: <br /> WHEREAS, in the interest of public safety the CITY proposes to add traffic signals and to <br /> improve crossing warning signal devices at the location listed in E�ibit A;and <br /> WHEREAS, the parties mutually agree to accomplish the proposed improvements through the use <br /> of Federal and/or State and City funds which are provided under applicable Federal, Staie, or City act,law <br /> or appropriation. <br /> NOW, TT�REFORE, in consideraxion of the premises and of the mutual covenants and <br /> agreements as hereinafter contained,the parties hereto agree as follows: <br /> SECTION 1. The project covered under this agreemeirt shall be subject to all appropriate Federal <br /> and Sta.te laws, rules, regulations, orders and approvals pertaining to a11 agreements, specifications, award <br /> of contra.cts, acceptance of work and procedure in general. The CTTY and the COMPANY shall be <br /> governed by the applicable provisions of the Federal-Aid Policy guide, Part 646, dated December 9, 1991, <br /> and any supplements or amendments thereto hereinafter referred to as the"Policy Guide". <br />� - — -- <br />
