9.6 TITLE VI CIVIL RIGHTS ACT OF 1964 <br /> The OWNER'S REPRESENTATIVE must comply with the regulations relative to <br /> nondiscrimination in federally assisted programs as required under Title VI of the Civil <br /> Rights Act of 1964, as amended, and Title 47 Code of Federal Regulations (CFR), Part <br /> 21, as amended, of the U.S. Department of Transportation. <br /> 9.7 COMPLIANCE WITH FEDERAL LOBBYING REGULATIONS <br /> In accordance with Section 1352 of CFR 31, no appropriated funds may be expended by <br /> the recipient of a federal contract, grant, loan, or cooperative agreement to pay any <br /> employee of any agency, Member of Congress, or an officer or employee of Congress in <br /> connection with any of the following covered federal actions: the awarding of federal <br /> grants; the making of any federal loan; the entering into of any cooperative agreement; <br /> the extension, continuation, renewal, amendment, or modification of any federal contract, <br /> grant, loan, or cooperative agreement. <br /> Each OWNER'S REPRESENTATIVE is required to review the above regulations and <br /> complete and submit a certification of compliance with federal lobbying regulations <br /> (Attachment D). Pursuant to federal regulations, the OWNER'S REPRESENTATIVE is <br /> required to have all subcontractors providing more than$100,000 in services to also <br /> complete this certification. <br /> 9.8 DISADVANTAGED BUSINESS ENTERPRISE (DBE) <br /> The OWNER'S REPRESENTATIVE must comply with the U.S. DOT's requirements <br /> (Title 49, Part 23 of the Code of Federal Regulations, dated July 21, 1983) entitled <br /> "Minority Business Enterprise in Department of Transportation Programs." (Attachment <br /> �• <br /> 9.9 COVENANT AGAINST GRATUITIES <br /> By signing this Agreement,the OWNER'S REPRESENTATIVE warrants that they have <br /> not offered or given gratuities (in the form of entertainment, gifts, or otherwise) to any �' <br /> official or employee of the CITY, with a view toward securing favorable treatment in the <br /> award, amendment, or performance evaluation of work done under this Agreement. I <br /> 9.10 EMPLOYEE PROTECTION REQUIREMENTS <br /> The OWNER'S REPRESENTATIVE shall comply with any applicable employee <br /> protection requirements for non-construction employees of section 102 of the Contract <br /> Work Hours and Safety Standards Act, as amended, 40 U.S.C. ss 327-332, and U.S. DOL <br /> regulations, "Labor Standards Provisions Applicable to Contracts Governing Federally <br /> Financed and Assisted Construction(also Labor Standards Provisions Applicable to <br /> Non-construction Contracts Subject to the Contract Work Hours and Safety Standards <br /> Act),"29 C.F.R.
