The City recognizes the Union as the sole and exclusive bargaining <br /> representative for a11 permanent, full-time Police Patrol Officers and Police Sergeants in the <br /> classified police service for the purpose of bargaining with respect to salaries, wages, hours and <br /> conditions of employment. The Union expressly acknowledges that it is not the bargaining agent <br /> for the positions of Lieutenant, Commander and Police Chief, said positions having duties and <br /> responsibilities that are supervisory in nature and different from those of Patrol Officer or <br /> Sergeant and the job descriptions, with the effective dates thereof, of Lieutenant and Commander <br /> being attached hereto, and the Union further acknowledges that occupants of said positions are <br /> not subject to the terms and conditions of this Memorandum of Understanding nor are the <br /> responsibilities thereof subject to any,duty to bargain. <br /> ARTICLE 2 <br /> PLACE OF RESIDENCE <br /> Section l. Persons appointed to positions in the classified police service shall reside <br /> within forty (40) miles of the corporate limits of the City of Decatur. Upon original appointment, <br /> an appointee may reside outside said limits but shall be required as a condition of continued <br /> employment to comply with said residency requirement no later than ninety (90) days after the <br /> completion of said appointee's probationary period. All non-probationary officers residing outside <br /> said residency requirement on April 30, 1997 shall not be required to comply with said residency <br /> requirement. <br /> Section 2. , In the event that an employee cannot report for duty at the assigned time, <br /> for any reason related to the location of the employee's place of residence if such is not in Macon <br /> County, the employee may call an on-duty command officer to request an emergency holiday if <br /> the employee has accumulated holiday time sufficient to cover the duty day or time of delay in <br /> reporting to work. The request will be granted, if at the time of the request, the affected shift or <br /> unit has stai�ing sufficient to provide police service at the level required by the anticipated <br /> workload for that time period. <br /> 2 <br />
