Excerpts from Plan Commission Meeting of January 7, 2016:
Cal. No. 15-23 Petition of HAMOUD HIZAM to rezone property located
at 1402 and 1412 EAST HICKORY STREET from R-3
Single Family Residence District to B-1 Neighborhood
Shopping District.
Ms. Suzy Stickle was sworn in by Mrs. Janet Poland.
Ms. Stickle presented the recommendation of staff:
The subject site is approximately .28 acres and is located at 1402 and 1412 East Hickory Street. The
site is currently developed with a 2,000 square foot commercial structure and a single family
residential structure.
The petitioner proposes to rezone from R-3 Single Family Residence District to B-1 Neighborhood
Shopping District to allow for all those uses permitted in the B-1 Neighborhood Shopping District.
The surrounding zoning in all directions is R-3 Single Family Residence District. The Macon County
and Decatur Comprehensive Plan shows this area as Residential-Low Density. The permitted land uses
in the B-1 District are compatible with the residential land uses as the B-1 Neighborhood Shopping
District is designed to encourage and facilitate commercial activities in the neighborhoods in which
they serve.
Although the Comprehensive Plan shows this area as Residential-Low Density, staff is of the opinion
that uses permitted in the B-1 District will not alter the essential character of the general area as the B-
1 District was established to allow these types of establishments in the neighborhoods to serve its
residents. There is currently a commercial building on site which was established in the neighborhood
years ago and it would be able to be repurposed if the lot were to be rezoned along with the demolition
of the single family structure to provide an area for parking to serve the commercial structure.
If the property is rezoned to B-1 Neighborhood Shopping District and redevelopment occurs, the
adjacent properties will have a buffer yard between the residential properties and the development in
accordance with the regulations of the Zoning Ordinance.
Staff recommends approval of the rezoning.
Section XXIX. of the City of Decatur Zoning Ordinance requires the Plan Commission to hold a public
hearing on a rezoning request, and then forward its report and recommendation to the City Council for
final approval. A motion to forward Calendar Number 15-23 to the City Council with a
recommendation for approval is suggested.
Mrs. May Cave, representative, was sworn in by Mrs. Poland.
Mrs. Cave stated the petitioner is currently the owner of 1402 East Hickory Street and would like to
rehabilitate the existing building for a future business. Mr. Hizam recently purchased the abandoned ,
house at 1412 East Hickory Street which is directly to the east of 1402 East Hickory Street. He is I
requesting the rezoning of both parcels which will allow him to add a parking lot, detention and buffer
yards to meet the City's requirements. Mrs. Cave said she feels this will be an amenity to the I
neighborhood.
Chairman Glenn Livingston asked what type of business this was going to be. Mrs. Cave said a
convenience store.
There were no objectors present.
It was moved and seconded (Harris/Sotirof to forward Calendar No. 15-23 to the City Council with a
recommendation for approvaL Motion carried unanimously.
