Page 2 of 2 <br /> 375 North 22°a Street Rezoning <br /> June 6, 2002 <br /> which does not allow for automotive sales (NOTE: this requirement was in the 1960 Zoning <br /> Ordinance as well as the new Zoning Ordinance now in effect). <br /> 4. In order for staff to certify that the property is zoned properly, it is necessary to rezone the <br /> property to B-2, Commercial District. The property is adjacent to B-2 zoning to the north. <br /> STAFF ANALYSIS <br /> 5. Staff does not know how this use came to be established in the current B-1 District. It is not <br /> unusual for small businesses to be established for a long time before the City is aware of a <br /> violation. The zoning boundaries in this area do not follow easily discernible patterns, and <br /> the person who established the dealership may have been unaware of the zoning. In any <br /> case, it does not appear that the used car dealership at this location has had a negative effect <br /> on the general area. I <br /> 6. The uses allowed under the new Zoning Ordinance in the B-2 District are similar to those <br /> permitted under the 1960 Ordinance. Although the B-2 District is less restrictive than the <br /> B-1 District, the additional uses that would become permitted on this property are consistent <br /> with the uses allowed immediately to the north and those uses already established on East <br /> Eldorado Street. <br /> STAFF RECOMMENDATION <br /> 7. Staff recommends that the rezoning from B-1 to B-2 be approved. <br /> PLAN COMMISSION ACTION <br /> 8. Per Section XXVII.A of the 1960 Ordinance,the Plan Commission must hold a public <br /> hearing and make a report to the City Council regarding a rezoning petition. After receiving <br /> public input on the rezoning, a motion to approve the rezoning is recommended. <br /> The above report constitutes the testimony and recommendation of the Planning Division, <br /> Economic and Urban Development Department, City of Decatur. <br /> Steven J.
