The petitioner has entered into a Real Estate Purchase Agreement with the owner of the <br /> subject property. The sales agreement is contingent on the approval of the rezoning of the <br /> property from R-1 Single Family Residence to B-2 Commercial District. The properties <br />' adjacent to the subject site and owned by the petitioner are all zoned B-2. The petitioner <br /> proposes to develop the subject property in order to support their business. The petitioner has <br /> not indicated specific plans on future uses proposed for the property. <br /> STAFF ANALYSIS <br /> 4. The subject site is surrounded on two sides(east and south)by properties that are zoned B-2. ' <br /> Staff recognizes the potential of expansion afforded to the petitioner by the subject property. <br /> A B-2 classification would allow the petitioner this opportunity,that would otherwise not be <br />' possible with an R-1 classification. It must be noted that most of the properties along <br /> Oakland Avenue in that area and all the way to Pershing are zoned B-2 Commercial District. <br /> This is because of the commercial nature afforded by a location along a major thoroughfare. <br /> STAFF RECOMMENDATION <br /> 5. Although staff does not believe that expansion of the petitioner's business would adversely <br /> affect the neighborhood,the petitioner is urged again to be sensitive to the locality in their <br /> future plans and to provide buffers and screening were appropriate. Staff recommends '� <br /> approval of the petition as presented. <br /> PLAN COMMISSION ACTION � <br /> 1. Section XXVII. A. requires the Plan Commission to hold a public hearing on rezoning I�!, <br /> requests, and make a recommendation to the City Council. A motion to approve the rezoning '�, <br /> is recommended.
