' � • • � Page 2 <br /> Memo re: West Towne Square Rezoning and PUD Amendment <br /> October 08, 2001 <br /> Because of neighborhood objections,the Plan Commission approved the PUD amendment <br /> subject to the apartments having an underlying zoning of R-6. A Planned Unit Development is <br /> allowed only to develop according to the approved plan, in spite of the underlying zoning. <br /> Therefore, the apartments could not be changed to commercial use without an amendment to the <br /> PUD. Staff believes that the PUD provides adequate protection from conversion of the <br /> apartments to commercial uses and recommends that the rezoning and PUD be approved as <br /> proposed. <br /> POTENTIAL OBJECTION: The owners of the two neighboring properties to the east spoke at <br /> the Plan Commission hearing. The owner of the property immediately adjacent to the project <br /> stated that the developer had met some of his concerns in the final revision to the plans,but was <br /> still concerned about the underlying zoning and the actual widths of the buildings. The owner of <br /> the house at 1037 W. Wood Street was concerned about the underlying zoning and the effect of <br /> the use on the neighborhood. She passed out a petition opposing the project with 61 signatures. <br /> In addition, the Near Westside Restoration and Preservation Societ (NWRAPS) submitted a <br /> Y <br /> letter signed by their board members opposing the project. <br /> INPUT FROM OTHER SOURCES: None at this time. <br /> STAFF REFERENCE: Please contact Planning Manager Steven J.
