Excerpts from Plan Commission Minutes of December 7, 2000
Cal. No. 00-73 Petition of REAL ESTATE INVESTORS OF DECATUR, LLC., 101
South Main Street, for a Revised B-3 Neighborhood Shopping District
Plan at the SOUTHWEST CORNER OF KING STREET AND
FAIRVIEW AVENUE.
Ms. Miller outlined the staff report and presented the recommendation of staff:
Staff has reviewed the proposal for the 18.9 acre site and finds it meets most of the provisions of
the Zoning Ordinance. The proposed plan does not have the required number of parking spaces
required by the ordinance. The revised proposal increases the number of parking spaces by 178
over esting conditions to 759. Since the number of parking stalls provided is not an increase in
the esting nonconfornuty, the legal staff determined that a variance to the provisions of the
Zoning Ordinance will not be required. The new parking lot layout will improve parking flow at
the shopping center. The planning staff and the engineering staff have reviewed the site plan and
landscaping plan and find the proposal acceptable. Staff recommends approval of the Fairview
Plaza Revised B-3 Shopping Center District as submitted.
Mr. Shampine asked if there would be no building changes. Ms. Miller stated that the buildings
would be remodeled, not demolished.
Mr. Van Steenhuyse stated that the Zoning Ordinance stipulates the requirements for B-3 but
does not specify what action to take if changes are made. This action will place an approved plan
on file. Clarification of this issue will be made in the rewrite of the ordinance.
Mr. Shampine asked if the revision will increase the number of parking spaces. Ms. Miller stated
that the building was constructed prior to the adoption of the Zoning Ordinance and parking does
not meet the requirements of the ordinance. Mr. Van Steenhuyse stated that there are presently
520 parking spaces on site; the ordinance requires over 1,200. The revision will bring the number
of parking spaces to over 700. It is not possible to meet the requirements of the ordinance on this
site although the parking situation will be improved.
Mr. Don Sheffer of Homer L. Chastain and Associates was present and spoke for the petition
representing Real Estate Investors of Decatur. Mr. Sheffer stated that the previous discussion
outlined the changes to the traffic pattern and parking and the net effect would be improved tra,iic
flow and more parking spaces. The landscaping islands will direct traffic in an orderly manner.
There were no objectors present.
It was moved and seconded (Smith/Setina)to forward Cal. No. 00-73 to City Council with
recommendation for approval. Motion carried unanimously.
