39. PARKING METER ZONES. Parking meter zones are hereby <br /> established upon the streets of the City, upon the municipal parking lots operated <br /> by the City and other City parking facilities as defined and designated by <br /> ordinance. Parking meters shall be installed in said zones under the direction of <br /> the Director of Engineering and Infrastructure alongside of or next to individual <br /> parking spaces designed and marked upon the pavement or parking area. <br /> Section 3. That Section 1 of Chapter 36 of the City Code of the City of Decatur, Illinois, <br /> be, and the same is hereby, modified and amended, so that said Section 1, as so modified and <br /> amended, shall provide as follows: <br /> 1. TREES, SHRUBS, AND GROUND COVERS ON CITY <br /> PROPERTY. No trees, shrubs, or ground covers may be planted, removed or <br /> pruned on City property, including streets and rights-of-way, unless a permit <br /> therefor is obtained from the City Forester. Conditions for issuance of permits by <br /> the City Forester shall be included in the Arboricultural Specifications Manual, as <br /> adopted and amended by the Department of Engineering and Infrastructure and on <br /> file with the City Clerk. The issuance of this permit shall not grant any property <br /> rights to the holder of the permit and all property shall remain the property of the <br /> City of Decatur. Any work related to trees on city property will be in accordance <br /> with the aforementioned Arboricultural Specifications Manual. <br /> Section 4. That Section 4 of Chapter 38 of the City Code of the City of Decatur, Illinois, <br /> be, and the same is hereby, modified and amended, so that said Section 4, as so modified and <br /> amended, shall provide as follows: <br /> 4. RULES AND REGULATIONS. The Director of Engineering and <br /> Infrastructure is hereby authorized to promulgate reasonable rules and regulations <br /> not in conflict with the provisions hereof for the administration and enforcement <br /> of this Chapter. <br /> Section 5. That Sections l, 2, 8 and 13 of Chapter 39 of the City Code of the City of <br /> Decatur, Illinois, be, and the same are hereby, modified and amended, so that said Sections 1, 2, <br /> 8 and 13, as so modified and amended, shall provide as follows: <br /> 1. PERMIT REQUIRED - TRANSFER OR ASSIGNMENT. No <br /> person, firm or corporation shall use any space underneath the surface of any <br /> street or other public ground or construct or maintain any structure thereunder <br /> without first obtaining a permit so to do from the City, issued by the Director of <br /> Engineering and Infrastructure. No permit or any right or privilege thereunder <br /> shall be transferred or assigned except upon consent of the said officer. Such <br /> permits are personal to the permittee and do not run with the land, and do not <br /> create any right,title or interest in the public ground so occupied. <br />
