2. APPLICATION. Applications for such permits shall be made to the <br /> Director of the Department of Engineering and Infrastructure stating specifically <br /> the space desired, its breadth and depth, the use intended to be made thereof and <br /> the structure to be built thereon. No permits sha11 be issued hereunder for the use <br /> of any space under the surface of the roadway of any street or other public ground. <br /> 8. FAILURE TO SECURE PERMIT. If any person, firm or <br /> corporation using any such space, and any grantee of the abutting property, shall <br /> fail to take out a permit as herein provided, then the Director of Engineering and <br /> Infrastructure shall proceed to remove every such structure and close such space <br /> therein; provided, however, this action shall not apply to any person, firm or <br /> corporation using any such space under special permit of the City so long as the <br /> conditions of said permit are carried out by the user thereof. <br /> 13. SAFETY OF PUBLIC. Whenever any coal hole, vault or elevator <br /> under any sidewalk of any aperture constructed in any sidewalk is not covered or <br /> firmly secured, or in the opinion of the Director of Engineering and Infrastructure <br /> is unsafe or inconvenient for public travel, said Director may order the same to be <br /> placed in a safe condition satisfactory to him; and if the same shall not be done <br /> within two days from the service of notice on the owner or person in possession of <br /> the premises, said Director may make such change and the expense thereof shall <br /> be paid by such owner or person in possession of the premises. <br /> Section 6. That Sections 4 and 12(B) of Chapter 41 of the City Code of the City of <br /> Decatur, Illinois, be, and the same are hereby, modified and amended, so that said Sections 4 and <br /> 12(B), as so modified and amended, shall provide as follows: <br /> 4 EX AVATED MATERIAL. In all avement construction under an <br /> . C p y <br /> ordinance hereinafter enacted all brick or other excavated material not used in the <br /> work shall remain the property of the City. The contractor shall convey such <br /> materials to such point in the City as may be designated by the Director of <br /> Engineering and Infrastructure, but not more than 2,000 feet. All surplus not so <br /> claimed or directed to be conveyed by the City shall be the property of the <br /> contractor to be disposed of by him as he shall see fit. <br /> 12. SALES ON SIDEWALKS AND PUBLIC PLACES. ... <br /> (B) The City Manager may issue a license to the owner or operator of any <br /> restaurant, as defined and licensed by the Macon County Board of Health, and <br /> which restaurant occupies and uses a building located in the Central Business <br /> District, for the sale and service of food for immediate consumption on public <br /> sidewalks adjacent to said building. The location of any tables, chairs or other <br /> furniture, or of any object or structure whatsoever to be used in conjunction with <br /> such sale and service of food, shall be approved by the Depaztment of Engineering <br /> and Infrastructure; no table, chair or other object may be located within four (4) <br />
