City Plan Commission <br /> July 2, 1998 <br /> Page Ten <br /> Mr. Schiller stated that this particular corner needs to be developed which is unlikely unless the <br /> development is commercial. He suggested forwarding the petition to City Council with an <br /> affirmative vote. <br /> Mr. Shampine stated that this is a clear intrusion into the neighborhood. The property has been <br /> vacant for the reason of providing geen space for the church. Commercial use is on the other <br /> side of the street but not on this side. Mr. Shampine stated that the building is attractive but not <br /> appropriate for the neighborhood. <br /> It was moved and seconded (Shampine/Woolsey)to forward Cal. No. 98-36 to City Council with <br /> recommendation for denial. Motion carried at a vote of five to three. Commissioners voting yea: <br /> Clevenger, Setina, Shampine, Washington, and Woolsey. Commissioners voting nay: Hill, <br /> Schiller and Demirjian. <br /> Cal. No. 98-37 Petition of DON McMII.,LEN to rezone a tract of land located at the <br /> northeast corner of Arbor Drive and North Oakland Avenue from R-1 <br /> Single Family Residence District to R-3 Single Family Residence District. <br /> Mr. Phillip Cochran, Consulting.Engineer, was present and spoke for the petition representing <br /> Mr. McMillen. Mr. Cochran stated that Mr. McMillen had purchased this parcel and the parcel <br /> next door. The property to the south is zoned R-3 and to the west is a Planned Unit <br /> Development. The existing watermain is in Arbor Drive and there is a sanitary sewer on site. <br /> The single family development would use less water than the previously proposed development at <br /> � this location. Mr. Cochran clarified that the total acreage is 15 acres. The petition for rezoning <br /> includes only the west five acres. A subdivision plat will hopefully be submitted ne�month. <br /> There were no objectors present. <br /> Mrs. Townsend presented the recommendation of staff: <br /> The subject petition requests that the premises commonly known as the northeast corner of <br /> Oakland Avenue and Arbor Drive be rezoned from R-1 Single Family Residence District to R-3 <br /> Single Family Residence District. Containing approximately five acres, the area in question is <br /> presently undeveloped. The purpose of the proposed rezoning is to allow the construction of a <br /> single family subdivision. <br /> Inasmuch as property to the immediate south and east aze presently zoned R-3 Single Family <br /> Residence District, staff is of the opinion that the proposed zoning is consistent and compatible <br /> with zoning and lot patterns in the general area. Further, the Comprehensive Land Use Plan <br /> designates this tract as a Single Family Residence District. <br />
