McQueen, Senior Planner (�6�"` <br /> SUBJECT: Ordinances granting Special Use Permits for communication towers at 2205 <br /> North Brush College Road, 327 South Martin Luther King, Jr., Dr., and 3780 East <br /> Fulton Avenue <br /> The subject petitions request Special Use Permits in accordance with applicable provisions of the <br /> Zoning Ordinance (Ord. #3512) to allow construction and operation of a free standing 150 foot <br /> high communication tower at the subject addresses. The tract at 3780 East Fulton Avenue is <br /> zoned B-2 Commercial District while the premises at 2205 North Brush College Road and 327 <br /> South Martin Luther King, 7r., Dr. are zoned M-1 Light Industrial District. <br /> Five years ago the Zoning Ordinance was amended to provide for communication towers as a <br /> special use permit in any zone. Prior to that amendment, the towers were allowed as a use by <br /> right in the light and heavy industrial zones. Staff has encouraged and petitioners have attempted <br /> to locate these towers in isolated areas away from residential developments. <br /> With regards to the proposal on Fulton Avenue, staff recommends approval of the petition with <br /> the following stipulations: (1)that a minimum setback of 150 feet be provided from the north <br /> right-of-way line of Fulton Avenue to the proposed tower, (2)that a fence having a minimum <br /> height of ten feet be constructed around the base of the tower, (3) that rungs on the tower be <br /> removed a minimum of forty feet above the base upon completion of construction, (4)that <br /> landscaping approved by the Department of Community Development be provided around the <br /> base of the tower, (5) that construction be subject to approval by the Federal Aviation <br /> Administration, and (6) that the development otherwise occur in accordance with plans submitted <br /> by petitioner with the subject request. <br />
