IV. RENT <br /> Lessee shall pay annual rent of Forty Thousand Dollars ($40,000), $8.00 per square <br /> foot of leased space. The rent shall be paid in equal monthly installments, each <br /> installment to be paid on the first day of each month without demand. After ten <br /> (10) days, there will be a late charge of Twenty-five Dollars ($25.00). After three late <br /> rent occurrences during any one year term of this Lease, Lessor will have the right to <br /> terminate the Lease and the Lessee shall vacate the Leased Premises within ten (10) <br /> days of written notice to terminate. The rent payable hereunder shall be payable to <br /> the Decatur Public Library, 130 North Franklin Street, Decatur, Illinois 62523, or such <br /> other address as the Lessor shall designate. <br /> The annual rent payment shall be increased at the end of the fifth year of the Lease in <br /> an amount equal to any increase in the Consumer Price Index for Urban Consumers, <br /> North Central Region, published by the Bureau of Labor Statistics of United States <br /> Department of Labor. The index number for the month of April 2000 shall be the <br /> ba�e index number and the corresponding index number for the then current month <br /> of April shall be the current index number. The current index number shall be <br /> divided by the base index number. From the quotient thereof, there shall be <br /> subtracted the integer 1, and any resulting positive number (rounded to 1,OOOths) <br /> shall be deemed to be the percentage of increase. The percentage of increase <br /> multiplied by the base rent, $40,000, shall be the additional rent required. In no event <br /> shall the additional annual rent be increased by more than 5%, so that the rent for <br /> the sixth year shall not exceed $42,000 or $44,100 for the seventh year, etc. <br /> V. USE <br /> Lessee shall use the Leased Premises for a retail bookstore and in conjunction with <br /> the bookstore may sell coffee and soda beverages a�d pastry, not prepared on the <br /> Leased Premises. Lessee shall not cook in any manner on the Leased Premises,� <br /> except that preparation of coffee beverages and the use of a microwave shall not be <br /> deemed in contravention of this cooking prohibition. Lessor agrees that it will not <br /> rent any other space in the Library building for retail bookstore use or the sale of <br /> beverages during the term of this Lease. <br /> VI. LESSOR'S WORK AND LESSEE'S WORK <br /> Prior to commencement of the Lease, Lessor shall complete in a workmanlike <br /> manner, all work identified on Exhibit B as Lessor's Work. Work identified on <br /> Exhibit C as Lessee's Work shall be performed by Lessee. Lessee shall have no <br /> payment obligation until Lessor's Work is substantially complete or until such time <br /> as the term hereof as set forth in Article II begins, whichever is later. Lessor's Work <br /> includes approximately $50,000 of build out construction directly benefiting the <br /> Leased Premises. If Lessee vacates the L,eased Premises prior to five (5) years from <br /> the commencement of the Lease term, Lessee shall pay Lessor as follows: <br /> � <br /> -2- <br />
