, Vacation after one (1) year - 80% of the build out construction <br /> Vacation after two (2) years - 60% of the build out construction <br /> Vacation after three (3) years - 40% of the build out construction <br /> Vacation aEter four (4) years - 20% of the build out construction <br /> Vacation after five (5) years - 0% of the build out construction <br /> Lessor shall have the right to terminate this agreement if the cost of Lessor's Work <br /> exceeds $175,000. Lessee shall have the right to terminate this agreement if the cost <br /> of Lessee's Work exceeds $80,000, excluding the cost of furnishings. <br /> Lessee acknowledges that Lessee's Work may be subject to the requirements of the <br /> Prevailing Wage Act. <br /> VII. COMMON AREA MAINTENANCE CHARGE <br /> Lessor has a rental area of approximately 35,000 square feet. This rental area will <br /> include a space for corridors, lobby and restrooms of approximately 4,000 square feet <br /> for the benefit of all tenants. In addition to the rent payment, Lessee agrees to pay a <br /> prorata share of the common area maintenance charge, said prorata share to be <br /> Lessee's percentage of the total rental area, 14.28%. This common area maintenance <br /> charge is payable monthly. Lessor shall notify Lessee by the 15th day of the month of <br /> the amount of the common area maintenance charge and Lessee shall pay the <br /> charge by the 15th day of following month. Lessee will be responsible for janitorial <br /> services for the Leased Premises. <br /> � VIII. ELECTRICITY, GAS AND WATER CHARGES � ' <br /> Lessee shall pay for electricity, gas and water charges for the Leased Premises. The <br /> total area for which electricity and water charges will be assessed is approximately <br /> 140,000 square feet. Lessee's prorata share of the electricity and water charges will be <br /> 3.57%. (5,000 square feet divided by 140,000 square feet). Lessee's charge for gas shall <br /> be based on Lessee's gas use. <br /> IX. LEASEHOLD TAXES . <br /> Lessee shall be liable for all taxes imposed on the Leased Premises. <br /> X. SIGNAGE <br /> All signs placed on the Leased Premises or on any Library premises shall have the <br /> prior approval of Lessor. All signs must comply with all applicable laws, <br /> ordinances, rules, and regulations. <br /> r <br /> -3 - <br />
