He stated that a great deal of work has been done in the area, not <br /> just by T�VRAPS, and that it was unfair to include the park. <br /> Mr. Larry Fichter, States Attorney of Macon County, was present as legal counsel for Macon <br /> County. Mr. Fichter stated that the County received notice as a ta.�cing body on November 22, <br /> 1999. He stated that it was necessary to bring to the Board's attention that they are operating , <br /> under a different set of rules. He felt that the issue of notice was a concern and that the � <br /> requirements of operating have been amended. <br /> ibtr. Owen questioned if the Board was operating under the old law or the new amendments. NIr. <br /> Froehlich stated that the board is operating under the old law. The costs for planning under the <br /> present TIF Act would be much more expensive. <br /> �1r. Owen questioned if notice provided had been sufficient. Mr. Froehlich stated that there could <br /> have been a problem if the City did not allow time for the members of the Board to receive and <br /> digest the information provided. The feasibility study was distributed on November 19 providing <br /> adequate time for review. <br /> Vfr. Owen questioned if Mr. Talbott's entity should have received notice. vlr. Froehlich stated <br /> that the list of ta.xing bodies would have to be reviewed. <br /> i�Ir. Fichter stated that the statute states that notice should be immediate. vlr. Owen stated that <br /> the Board is not designed or qualified to determine the requirement of notice that an entity has or <br />, has not received. <br /> i�Irs. Jackie Goetter, President of the Decatur School Board, was present and addressed the <br /> Board. Mrs. Goetter questioned if the Board was meeting for the sole purpose of determining <br /> qualifications, and if so, would the Board convene at another time to review the plan. <br /> vlr. Froehlich stated that the only purpose was to make a decision on the area's qualifications. He <br /> a;reed that the act is very confusing. The only issue before the board for a vote is eligibility. <br /> LIr. Bruce Paulsen, 451 West Macon, was present and addressed the board. Mr. Paulsen stated <br /> that he is a present member and past president of NWRApS. TtWRApS had first worked with the <br /> City to reduce crime and is now working intensely with the City to get to the issues being <br /> addressed bv the board. <br /> vlr. Owen questioned if Mr. Paulsen agreed with the characterization of the area. Mr. Paulsen <br /> stated that all criteria were prevalent in the area. <br />
