4. Pavments <br /> The Consultant �vill submit invoices on a monthly basis, documenting work performance <br /> according to work performed. Documentation in support of performance may include a <br /> summary description of activity undertaken, estimated percent of completion of each <br /> Project Task currently being undertaken by Consultant, and relationship of activity <br /> to the Scope of Services. <br /> The Client shall pay the amount due within thirty (30) days thereafter. If the invoice is <br /> not paid within 30 days, the Consultant may suspend the performance of services upon <br /> written notice to the Client. Client shall reimburse any costs incurred by the <br /> Consultant in collecting delinquent amounts, including reasonable attorney's fees. If <br /> a portion of the Consultant's statement is disputed, the Client shall pay the undisputed <br /> portion by the due date. The Client shall advise the Consultant in writing of the <br /> basis for any disputed portion of any statement. <br /> 5. Time and EYpense Records <br /> The Consultant shall keep and maintain time and eYpense records relating to the <br /> attached Scope of Services, together with supporting receipts, vouchers and <br /> appropriate documentation. As necessary, these records and other appropriate <br /> documentation may be required to support invoices submitted to the Client. <br /> ^ The Client shall have the right to e:camine such records as it deems necessary � <br /> upon reasonable notice to the Consultant, and the time for payment may be <br /> extended as necessary to allow time for any such review. <br /> 6. Authorization of Chanees/Additional ChanQes/Additional Compensation <br /> Any changes or additional tasks required for the performance of this Agreement <br /> and any compensation due for the provision of additional service shall only be <br /> authorized by the Client upon approval by the City Council and the Consultant <br /> must first request those changes in writing. The Consultant shall be compensated <br /> for any additional tasks so approved and authorized, based upon fee determined <br /> by the Consultant and Client for professional services for making revisions in the <br /> project documents or related graphic materials when such revisions are <br /> inconsistent with approvals or instructions previously given or are due to causes <br /> beyond the control of the Consultant, or for providing any other services not <br /> customarily furnished in accordance with generally accepted consulting practice. <br /> Said compensation will be in addition to the budgeted fee indicated in Paragraph <br /> 3, above. In no circumstance will the Consultant be compensated for changes <br /> necessary through its own actions or inactions. <br /> -�- <br /> _ r � _ s <br />
