Sales Tax and Other Taxes. Only sales taxes or other taxes on services which are in <br /> effect at the time this Agreement is executed are included in the PROJECT fees. If the <br /> tax laws are subsequently changed by legislation during the life of this Agreement, the <br /> Agreement shall be adjusted to reflect the net change caused by such tax law changes. <br /> Responsibilities of OWNER <br /> The OWNER shall provide the following services as part of the PROJECT. <br /> a. Existing as-built drawings of public utilities and other information currently on ' <br /> file including electronic version of existing computer files. <br /> b. Historical reports and data on file pertinent to all phases of the PROJECT. <br /> c. Access to areas of the PROJECT site at reasonable times as required for the <br /> ENGINEER to complete the scope of services; and <br /> d. Availability of key OWNER staff at reasonable times and with reasonable notice <br /> to participate in meetings and one field person for fire-flow tests as required for <br /> duration of the PROJECT. <br /> Insurance <br /> ENGINEER shall provide professional liability,commercial general,workmen's compensation, <br /> employers liability, and automobile insurance coverage. A certificate of insurance will be <br /> provided to the OWNER prior to commencement of the project. <br /> Fees <br /> OWNER shall compensate ENGINEER for study-phase services in an amount not to exceed <br /> $44,500, which includes all expenses. <br /> ENGINEER's fee estimates are based on understanding of required service elements and are <br /> considered limiting fees. Actual fees shall be based on standard hourly rates for ENGINEER's <br /> actual time spent on the project at standard billing rate of 2.84 times hourly salary plus expenses <br /> at cost plus 5 percent. <br /> STRAND <br /> ASSOCIATES.
