NDC shall require that the lan�ua�e of this I� <br /> para`raph be included in the award documents of all subawards at all tiers includin� <br /> subcontracts, sub�rants, and contracts under grants, loans, and cooperative a�reements) and <br /> that all subrecipients shall certify and disclose accordin�ly. <br /> Drug Free �Vorkplace <br /> 1`DC a�yrees that it�vill maintain a drug free workplace in accordance with the requirements <br /> of?�l CFR?4, Subpart F and shall administer this proaram in adherence to HUD's policy for <br /> druQ and alcohol free facilities. <br /> lndependent Contractor <br /> ?�othina in this Aareement shall be deemed to represent that NDC, or any of NDC's <br /> employees or agents, are the a�ents, representatives, or employees of the City of Decatur. <br /> NDC shall be an independent contractor over the details and means for performing its <br /> business. r�nything in this Agreement which may appear to give City of Decatur the right to <br /> direct NDC as to the details of the performance of its business or to exercise a measure of <br /> control over NDC, are for purposes of compliance ��-ith HUD regulations and other local, <br /> state and Federal re;ulations and shall mean that NDC shall follow the desires of the City of <br /> Decatur only as to the intended results of the scope of this Agreement. <br /> Use of Debarred Contractors <br /> I�,rDC a�rees that no CDBG assistance shall be used directly or indirectly to employ, award <br /> contracts to, or otllerwise engage the services of, or fund any contractor during any period <br /> of debannent, suspension, or placement in ineli�ibility status under the provisions of 24 CFR <br /> Part ?4. <br /> 7 <br />
