, pursuant to this Agreement is two hundred forty (240) days. Employee sha11 not be entitled to any cash payment, or payment of any type for sick leave days unused as of the date of ternunation of this Agreement, and such dates are to be utilized for illness of Employee or immediate family members of Employee and are not considered vacation or personal days. � 9. PRIOR RELATIONSHIP. The parties acknowledge and agree that Employee heretofore served the City as Chief of Police, and will continue in said capacity until the effective date of this Agreement set forth in § 1. Upon execution hereof, and adoption by action of the City Council,the City shall pay to Employee the sum of$675.00 which constitutes 135 days of sick leave at $5 per day, and the remaining days of sick leave held by Employee, i.e., 105 days, shall be carried over into Employee's position as City Manager. The City shall also pay to Employee $5,145.49 which constitutes payment for vacation and holidays accrued during Employee's police service as of execution hereof. 10. AUTOMOBILE AND CELLULAR PHONE . Employee sha11 be provided the use of an automobile from the City's fleet of vehicles, which vehicle shall be insured at the expense of the City in amounts as determined by the City in its sole discretion. Said vehicle may be utilized by Employee for personal use within the geographical limits of the County of Macon, Illinois, but otherwise must be utilized solely for business of the City. Fuel for said vehicle and items of routine maintenance sha11 be provided by the City or performed at City owned or operated facilities at the sole expense of the City. The City makes no representation as to the manner in which said payments or benefits shall be allocated or considered by federal and/or state taxing authorities. The City shall further provide to Employee a pager at the sole expense of the City. -4-
