iv. Relocation of the Library shall not result in the Library being closed to the public <br /> for a period in excess of fourteen (14) business days unless the reason for the <br /> closing are for circumstances outside the control of the parties including, but not <br /> limited to, Acts of God, natural disasters, work stoppages, materials shortage and <br /> other extraordinary occurrences. <br /> I. Destruction. In case of damage by fire or other casualty to the Leased Premises <br /> without fault or negligence of the Library, its agents, officers or employees, if the damage is so <br /> extensive as to amount practically to the total destruction of the Leased Premises, the proceeds of <br /> insurance on the Leased Premises payable by reason of such destruction shall be paid to the City, <br /> this Lease shall terminate and the rent shall be apportioned to the time of the damage. The City <br /> shall use all of the insurance proceeds payable by reason of such destruction to acquire and <br /> construct replacement library space. The Library shall have the right to reasonably consent to <br /> the location, size, layout, and configuration of the replacement space and parking area. The <br /> Library shall not unreasonably withhold its consent. In all other cases where the Leased <br /> Premises is damaged by fire or other casualty without the fault or negligence of the Library, its <br /> agents, officers or employees, the proceeds of insurance on the Leased Premises payable by <br /> reason of such destruction shall be paid to the City, the City shall repair the damage with <br /> reasonable dispatch and if the damage has rendered the Leased Preinises untenantable, in whole <br /> or in part, there shall be an apportionment of the rent until the damage has been repaired. All <br /> repairs by the City shall be promptly made with materials of like quality to the original work. In <br /> case of damage by fire or other casualty to the Leased Premises due to the fault or negligence of <br /> the Library, its agents, officers or employees, this Lease shall continue in full force and effect, <br /> without abatement of rent, and the Library shall repair the damage with reasonable dispatch and <br /> Pagel0of15 <br />
