commencement of the applicable five (5) year period. The first potential increase to the annual <br /> rent amount will occur on May 1, 2021, and each five (5) years thereafter. The rent shall be <br /> paid in monthly installments due and payable on the fifteenth (15`�') day of each month effected <br /> by a journal entry by the City Treasurer on said date. Notwithstanding the foregoing, in no event <br /> shall the annual rent amount pursuant to this Lease exceed twenty-two percent (22%) of the <br /> amount that the City actually levies for the Library. In the event that the annual rent amount <br /> exceeds twenty-two percent (22%) of the amount actually levied by the City for Library, the <br /> Library's annual rent amount under this Lease shall automatically be reduced to twenty-two <br /> percent (22%) of the amount levied by the City for the Library. <br /> SECTION 3. Operation and Maintenance <br /> A. The City shall provide heat, air conditioning, light, power, water, sewer and all other <br /> basic utilities for the Leased Premises, the Library Building and the Common Areas. The City <br /> shall also repair, maintain, and replace, if required, the heating, ventilating, air conditioning, <br /> plumbing, electrical systems, and the physical structure of the Library Building, Leased Premises <br /> and Common Areas, including, but not limited to, windows, roofs, ceilings, floors, and walls (but <br /> not including any trade fixtures or alterations made by the Library pursuant to Section 10 of this <br /> Lease Agreement after the Effective Date). The Library shall have no obligation to repair, <br /> maintain, or replace any aspect of the Common Areas, Building, Leased Premises or any <br /> Building systems serving the Leased Premises. <br /> The City shall clean and maintain the Leased Premises and schedule the cleaning and <br /> maintenance so as to cause the least inconvenience to the public use of the Library as set forth in <br /> Exhibit C. <br /> Page 2 of 15 <br />
