4. The Contractor will pick up the vehicle trip sheet for each day when they come to <br /> the DPTS storage facility to get the van. <br /> 5. The City shall, at City's own expense, defend all suits that may be brought against <br /> the Contractor on account of, or in connection with, or by reason of any damage <br /> or injury to life, limb or property, *connected with, growing out of or caused by <br /> any act or omission to act of Contractor or any employee of Contractor in or about <br /> the operation of said vehicle, **hereunder and shall save and keep hannless <br /> Contractor from any and all damages, judgments, costs and expenses of every <br /> kind that may arise or result by reason of the negligence of Contractor or the <br /> employees of Contractor by reason of, growing out of, or connected with the <br /> operation of said program and the carrying out of the terms and provisions of this <br /> Agreement. <br /> 6. The operators provided for the Program shall be employees of the Contractor. The <br /> Contractor shall certify to the City for each operator that: <br /> a. The Contractor has workers compensation coverage for the operator; <br /> b. The operator has passed a physical examination as specified by the City; I <br /> c. The operator has passed a drug test as specified by the City; �� <br /> d. The operator has the necessary valid operator's or CDL license; <br /> e. The operator has never had his or her operator's license suspended; <br /> f. The operator has never been convicted of, or pleaded guilty to, a felony <br /> charge; and <br /> g. The Contractor has confirmed personal and professional references as <br /> given by the operator. <br /> 7. The operators so provided will be subject to City supervision and to applicable <br /> bulletins, rules and regulations established for the Decatur Public Transit System. <br /> Any violation of said bulletins or rules and regulations will be reported to the <br /> Contractor and the Contractor shall take disciplinary action as is appropriate and <br /> agreeable to the City. <br /> * including any loss of passenger's personal property,however such loss <br /> may occur. <br /> ** or,the operation of the vehicle lift equipment, or,the transfer of the <br /> passengers to or from the vehicle or to or from their final destination. <br /> 6 <br />
