I <br /> �• . � 9s-- c� y <br /> t• 05/95 <br /> CDECATUR <br /> AGREEMENT FOR PLANNING SERVICES <br /> BETWEEN <br /> CITY OF DECATUR <br /> AND <br /> THE STATE OF ILLINOIS, ACTING BY AND THROUGH ITS <br /> DEPARTMENT OF TRANSPORTATION <br /> THIS AGREEMENT, entered into as of this �� day of 1995, by and befinreen <br /> the City of Decatur hereinafter called the PLANNING AGEN , a ody politic and corporate <br /> created by the State of Illinois, and the State of Illinois, acting by and through its Department <br /> of Transportation, (hereinafter called the DEPARTMENT), and which is for regional <br /> transportation planning and related planning activities in the county of Macon (hereinafter <br /> called the "planning area") in the State of Illinois, and particularly in the designated <br /> urbanized areas of the planning area. <br /> WITNESSETH THAT: <br /> WHEREAS, the DEPARTMENT is mandated by law to develop transportation plans <br /> and programs in cooperation with federal, state and local agencies, and <br /> WHEREAS, the PLANNING AGENCY has specialized expertise in the area of <br /> transportation and land use planning and associated technical services, and thereby has the <br /> necessary technical skills. <br /> NOW THEREFORE, the parties hereto do mutually agree as follows: <br /> I. � I�oyment of PLANNING AGENCY. The PLANNING AGENCY hereby agrees to <br /> perform the services described in Appendix A, which is attached hereto and made a <br /> part of this AGREEMENT and as set forth in the approved Unified Work Program for <br /> Transportation planning. The Unified Work Program is by reference incorporated <br /> herein and made a part of this AGREEMENT. <br /> 2. Services by DEPARTMENT. The DEPARTMENT shall assist the PLANNING <br /> AGENCY by providing the services described in Appendix B. <br /> 3. L�esqonsibilities of the PLANNING AGENCY <br /> A. The PLANNING AGENCY, or an approved subcontractor, shall perForm and <br /> carry out, in a satisfactory and proper manner, as determined by the <br /> DEPARTMENT, the services specified by this AGREEMENT and in Appendix A, <br /> which is attached hereto and made a part of this AGREEMENT. In performing <br /> the services specified by this AGREEMENT, the PLANNING AGENCY shall <br /> follow generally accepted planning practices consistent with the highest <br /> professional and technical standards. <br /> 1 <br />
