4. MANPOWER will pick up the vehicle trip sheet for each day <br /> wh,en they ccRne to the DPTS storage facility to get the van. <br /> 5. The City shall, at City's awn expense, defend all suits that <br /> may be brought against MANPOV�R on account of, or in connec- <br /> tion with, or by reason of any damnage or injury to life, limb <br /> or property,*connected with, growing aut of or caused by any <br /> act or canission to act of N�,NPOWER or any eqnployee of N�NPC�InT- <br /> ER in or about the operation of said vehicle,**hereunder and <br /> shall save and keep harmless N�TPOWER fran any and all <br /> damages, judcynents, costs and expenses of every kind that may <br /> arise or result by reason of the negligence of N�NPOWER or <br /> the employees of MANPOWER by reason of, grawing aut of, or <br /> connected with the operation of said program and the carrying <br /> out of the tern�s and provisions of this Agreement. <br /> 6. The aperators provided for the Program shall be employees of <br /> MANPOWER. MANPOWER shall certify to the City for each opexa- <br /> tor that: <br /> a. MP�TPOWER has workers carrpensation cavexage for the <br /> operator; <br /> b. The operator has passed a physical examination as speci- <br /> fied by the City; <br /> c. The operator has passed a drug test as specified by the <br /> City; <br /> d. The operator has the necessary valid operator's license; <br /> e. The operator has never had his or her operator's license <br /> suspended; <br /> f. The operator has never been convicted of, or pleaded <br /> guilty to, a felony charge; and <br /> g. MANPOWER has confirnned persanal ar�d professional refer- <br /> ences as given by the ope�ator. <br /> 7. The operators so provided will be subject t�o City supervision <br /> and to applicable bulletins, rules and regulations estab- <br /> lished for the Decatur Public Transit System. Any violation <br /> of said bulletins or rules and regulations will be reported <br /> to MANPOWER an�d M�TP(7WER shall take disciplinary action as is <br /> appropriate and agreeable to the City. <br /> * including any loss of passenger's personal property, <br /> haaever such loss may occur, <br /> ** or, the operation of the vehicle lift or ra�np equignent, <br /> or, the transfer of the passengers to or fro�n the vehi- <br /> cle or to or fro�n their final destination. <br />
