The recyclin� containers shall be as <br /> defined hereinabove. Contractor shall deliver the recycling containers to <br /> each dwelling within ten working days after they are made available to <br /> Coiitractor for delivery. The recyclina containers shail be and r�nain the <br /> property of Contractor during the term of this a�re�ient. In the event that <br /> the Cit;� does not extend this Agre�r�nt after the first one year term, the <br /> City shall purchase the containers by paying to the Contractor a sun equal to <br /> 2/3 of the actual cost of those containers actually distributed, said payment <br /> to be made on the date of termination. In the event City exercises one <br /> extension but does not exercise the second extension, then City shall purchase <br /> the containers by Qaying to Contractor 1/3 the actual cost of those containers <br /> actually distributed, said payment to be made on the date this �reernent <br /> terminates. If this A�reement has been extended twice, tF�en at the end of the <br /> second extension, the containers shall become the property of the City. <br /> 3.7. Contractor shall supply arid deliver all replacement recycling <br /> containers requested by a dwellin� resident as soon as possible after such <br /> request is made. Contractor may charge to the City the costs of such <br /> replacement of recyclino containers; provided, however, the Contractor shall <br /> use its best efforts and all due diligence, without charde to the City of <br /> Decatur or any resident of the dwelling, to obtain new recyclin� containers <br /> frcrn the manufacturer thereof under the manufacturer's warranty when a <br /> replacelnent recycling container is made necessary �ue to a cause which is, or <br /> reasonably could be, covered by such warranty, and if a new recycling <br /> container is obtained under such vuarranty no char�e shall be rnade therefore to <br /> the City or any resident of a dwelling. <br /> 5 <br />
