Operator in accordance with accepted good accounting practices as may be directed by the City under the terms hereof, and shall permit City, through such personnel as it may authorize, to examine and audit said records, books, and accounts at any and all reasonable times as City may elect, and Operator shall reimburse the City for any shortage or loss or over- charge, other than losses from theft, robbery or other causes beyond the control of Operator or its employees, that may be disclosed by such audit or examination. No funds shall be withdrawn from said bank, or banks, except upon the order of the City. 21) Operator shall furnish such periodic reports and recommendations to the City as City may require or as ' • may be deemed reasonably necessary by Operator regard- ing the operation, maintenance, extension, routing, service policies, scheduling and other aspects of the ' maintenance and operation of the transit system and the I improvement thereof and Operator shall annually prepare , and submit to the City in such form as City may deter- mine an operating and capital budget and projections. 22) Operator shall carefully and reasonably use and proper- ly maintain and keep in repair all transit system property and appurtenances of the City used by the Operator pursuant to its Agreement with the City, and shall keep such maintenance and inspections records as may be required by City from time to time. Said property appurtenances and records shall be made available for inspection by the City as it shall from time to time direct. 23) Operator agrees to abide by, all statutes of the State of Illinois, with regard to fair employment practices, and Operator shall further, in the performance of this contract, in no manner discriminate among persons or employees or otherwise for any purpose based upon age, sex, handicap, race, religion, creed, color or national origin. Operator shall submit to City within 90 days after commencement of the term of an Agreement with the City an Affirmative Action Plan for all employees of Operator in accordance with ordinances of City of Decatur. Operator shall also submit to the City within 90 days after commencement of the term of the aforesaid Agreement, a comprehensive hiring policy manual which will set forth the hiring practices which are consis- tent with all applicable federal, state, and local laws governing the hiring of employees. 24) Operator shall employ only persons of good moral character and reputation and shall conduct an investi- gation of all prospective employees.
