any damage or injury to life, limb or property connect- <br /> ed with, growing out of or caused by any act or omis- <br /> sion to act of Operator or any employee of Operator in <br /> or about the operation of said facilities hereunder and <br /> shall save and keep harmless the Operator from any and <br /> all damages, judgments, costs and expenses of every <br /> kind that may arise or result by reason of the negli- <br /> gence of Operator or the employees of Operator by <br /> reason of rowin out of or connected with the <br /> . 9 9 � <br /> operation of said facilities and the carrying out of <br /> the terms and provisions of this Agreement. <br /> If such contracts as are referred to herein are re- <br /> quired to be, and are, obtained by Operator, then, for <br /> those covered risks, as additional consideration for <br /> the reimbursement of Operator for the costs of such <br /> contract or contracts as provided herein, Operator <br /> shall, at Operator's own expense, defend all suits that <br /> may be brought against the City on account of, or in <br /> connection with, or by reason of any damage or injury <br /> to life, limb or property connected with, growing out <br /> of or caused by any act or omission to act of Operator <br /> or any employee of Operator in or about the operation <br /> of said facilities hereunder and shall save and keep <br /> harmless the City from any and all damages, judgments, <br /> costs and expenses of every kind that may arise or <br /> result by reason of the negligence of Operator or the <br /> employees of Operator by reason of, growing out of, or <br /> connected with the operation of said facilities and the <br /> carrying out of the terms and provisions of this <br /> Agreement. <br /> 18) Operator shall operate said transit system on the days, <br /> during the hours and over the routes with such schedul- <br /> ing, and at such fares as shall be approved or directed <br /> by the City from time to time. <br /> 19) Operator shall collect on behalf of the City and pay <br /> over to the City and account for to the City all <br /> revenue, fares and other income arising from the <br /> operation of the transit system, all of which shall be <br /> the property of the City. <br /> 20) Operator shall deposit in a bank, or in banks, desig- <br /> nated by the City all monies collected under the <br /> provisions hereof at such times and in such manner as <br /> may be directed by the City from time to time, and <br /> shall keep such daily and other periodic records as <br /> City may direct, and shall trasmit the same to City in <br /> the manner and form designated by City and shall keep <br /> and preserve, or if directed by City shall deliver to <br /> City, such tickets, receipts or other documents or <br /> instruments as City may direct to substantiate the <br /> records, books, and accounts of Operator to be kept by <br />
