INDEMNIFICATION. <br /> Lessor shall not be responsible for any defect or change of <br /> condition in the leased premises, nor for any damages thereto, nor <br /> to any person, nor to goods or things contained therein, due to any <br /> cause whatsoever, except the act or negligence of Lessor. Lessee <br /> hereby indemnifies Lessor from any claims, demands, actions and <br /> attorney's fees arising in connection with Lessee's use of the <br /> leased premises or the use of the leased premises by any person <br /> occupying the same during the term hereof, excepting claims, <br /> demands and actions arising out of an act or negligence by Lessor. <br /> 11. TERMINATION. <br /> This Lease may be cancelled and terminated by Lessor only in <br /> the event that Lessee or its successor fails to perform any <br /> material provision of this Lease Agreement for a period of sixty <br /> (60) days after notice of violation by Lessor or its successor. <br /> 12 . MAINTENANCE. <br /> Lessee shall maintain the property under this Lease and assist <br /> and cooperate with Lessor in the mowing and maintenance of the <br /> balance of the recreational area. <br /> 13 . QUIET ENJOYMENT. <br /> Lessor hereby covenants that Lessee shall, upon compliance of <br /> the terms of this Lease Agreement, have quiet enjoyment of the <br /> leased premises as if the same were owned by Lessee. <br /> 14. RECREATIONAL SERVICES. II <br /> Lessee agrees to cooperate with Lessor in the delivery of <br /> recreational services within the Phoenix Park area, but shall not <br /> be required to expend funds for the delivery of recreational <br /> services nor the provision of maintenance or security for Phoenix <br /> Park. Lessor agrees to make reasonable efforts to obtain funding <br /> for the delivery of services within Phoenix Park and the demised <br /> premises, to the extent it may do so under applicable State and <br /> Federal laws. Lessee shall not be obligated to provide services <br /> within the Phoenix Park area if Lessor fails to secure funding for <br /> the delivery of said services. <br /> 15. USE OF FACILITY. <br /> Lessee agrees to make the Boys Club facility available to <br /> support those social service functions which are deemed by Lessor <br /> to be of benefit to the residents of the Longview Public Housing <br /> Project, subject to the scheduled availability of said facility, <br /> the adequacy of said facility supervision and the availability of <br /> operating financial support for the services provided by the <br />
