In this case you own five of the six
sides of the three legs in the road and a 2nd party owns the 6th aide.
Normally, upon vacatioa of an area the entire vacated area accrues to
one owner as he or she own the land on both aides of the vacated area.
In this case the vast majority of the land vacated would go to ADM
but the North 25' of the East leg of the road would go to Ms. Querrey. .
As previously mentioned Brenneman Road extends from N. Brush College
Road on the West to Rowe Road on the East. There are no residential
properties along the proposed area Co be vacated except for one at the
' far East end of leg 3 which ia owned by ADM. The North end of Faries
Park, the Golf Course and Gun Club are available to east bound traffi""
on Brenneman Road via Rowe Road, Gua Club Road and Christmas Tree Road
all located to the North and East of the east end of Brenneman Road. •
The appraiser assumes that the maor volume of traffic on Brennemaa
Road is grain truck traffic hauling grain to the ADM East plant. The
condition of leg 1 of Brenneman Road attests to the truck traffic.
If Brennemaa Road was vacated there are two alternative roads to the
Faries Park area. Theae would include Rheas Bridge Road east from
N. Brush College and thence south on Christmas Tree Road and Faries
Parkwaq east from N. Brush College and thence Northerly into Faries
Park. (See locatioa map enclosed in report).
Vacation of Brenaeman Road would permit grain trucks to assemble on
that road fo eventual entry into the ADM East plant to discharge
their grain. It would appear that one advantage to the vacation
would be that grain trucks could assemble on ADM land rather than hav-
ing some park along N. Brush College Road. If Brenneman Road was
vacated public traffic would be eliminated and the Querreq owaership
would lose a public road along leg 3 of Brenneman road and access to
N. Brush College via Brenneman Road. Access to their propertq would
be via the roada on the east, namely, Rowe Road, Gun Club Road and ,
._ Christmas Tres Road. While subject is used as farm land this would
not appear to adversely affect the Quezrey land. It is zoned heavy
industrial but demand has been extremely light for new industrial
uses in Decatur since the 1970's. The major purchasers of industrial
land in the immediate area has been ADM who obviously purchased for
protection and future expansion.
Vacating the area would relieve the City of Decatur of the maintenance
of Brenneman Road.
