'�oning`Commititee' s recoinmendation is to exclude � . .. <br /> the� 15a �feet to the north' ot �the subj�ect property.. � � � . • <br /> Plat Committee Recommendations : The zoning request as submitted <br /> would permit a commercial type building to abut residential <br /> property to the north and in orc�er to provide some protection <br /> from that, the Plat Committee is recommending that instead of <br /> removing the 150' from the petition (as recommended by the Zoning <br /> Committee) , that a setback line be established a sufficient <br /> distance from the north property line. <br /> Mr. Krimmel advised that the petitioner would prefer a setback <br /> line as opposed to the zoning deletion. <br /> Staff Recommendations : Mr. Menzies reported that in staff ' s dis- <br /> cussion with both the Plat Committee and the Zoning Committee, <br /> the main concern was to try to determine a boundary line as it <br /> relates to the residences to the north. Staff ' s opinion is that <br /> zoning to B-2 commercial is in harmony with the developed com- <br /> mercial areas and staff would support the rezoning with the re- <br /> gui�ement .that a 150 ' building setback be placed on the plat to <br /> ensure that no building would be closer than this distance from <br /> the single family house to the north and not directly across the <br /> street from a house located on the east side of Brett Avenue. <br /> Mr. Cole inquired as to the general condition of the house. Mr. <br /> Menzies answered that it isn' t in a dilapidated state, but neither <br /> is it of high value. <br /> Mr. Krimmel stated that 150 ' would be almost 1/3 of the total <br /> property and would hamper development. He felt it would be un- <br /> fair to set 150' as a setback figure and indicated a figure of <br /> 75 ' as more acceptable. <br /> Mr. Likins stated he was hoping that the petitioner and staff <br /> would be able to work something out prior to the Plan Commission <br /> meeting. It was his feeling at the Plat Committee meeting }hat <br /> a setback figure of no less than 100 ' nor more than 150' was <br /> indicated. <br /> Mr. Grossman advised that the Commission should vote on the rezoning <br /> petition first, and then go to the plat because there are other <br /> things to be considered besides the setback question. <br /> Mr. Rrimmel stated he had hoped to have both petitions voted on <br /> at the same time. <br />.
