- 12 - <br /> Section 23. The application of provisions and requirements of <br /> this ordinance establishing minimum standards may be varied by the <br /> Construction and Housing Board of Appeal� i,f said Board finds that as <br /> to a particular $ituation there is practical difficulty and unnecessaxy <br /> hardship in the strict application thereof to such situation and that <br /> such application would be arbitrary a nd unreasonable and variation <br /> therefron would accord and b� in harmony with the general purposes of <br /> this ordinance and the general public health, safety and welfare. <br /> Section 24. Any person who violates any provision hereof, and <br /> any owner, occupant, or other person in charge of a structure or <br /> premise� who after having received a second notice of a violation of <br /> this ordinance has �ailed to comply therewith shall be fined not less <br /> than Five Dollars ($5.00) nor more than Five Hundred Dollars ($500.00) <br /> and each day upon which such violation is allowed to continue may be <br /> deen�d to be a separate offense. <br /> Section 2S. In addition to any other penalty or action provided <br /> or authori2ed hereby, the City may institute any appropriate action <br /> or proceeding to prevent any violation hereof, to restrain, correct <br /> or abate such aiolation, to prevent th� occupancy of any building or <br /> structure or part thereof, or to prevent the maintenance of a ny building, <br /> structur� or land in a condition in violation of this ordinance. <br /> Section 26. In any case where a provision of this ordinance is <br /> found to be in conflict with a provision of any zoning, building, fire, <br /> safety, or health ordinance or code of the City of Decatur, existing on <br />
